The Federal Association of Consumer Advisory Centers (vzbv) later withdrew its model declaratory action against the company, as vzbw board member Klaus Mller said Thursday. “Never before have so many consumers been able to benefit at once.” Mller emphasized that the trial would end a “landmark court case.”
According to VW, a total of around 750 million euros in payments related to the exhaust gas scandal will flow from May 5. “The goal of the comparison was to save tens of thousands of customers, Volkswagen, and the court system from lengthy procedures,” the company said. The fact that about 90 percent of the more than 260,000 people entitled to settle the settlement “clearly exceeded our expectations.” Depending on the age and type of vehicle, customers with amounts between 1,350 and 6,250 euros must be compensated. About 17,000 cases were still in testing on Thursday.
Volkswagen and vzbv agreed on the diesel comparison earlier this year. The agreement states that consumers affected by Dieselaffre will receive compensation for the loss of value of their vehicles. Car owners who joined the model declaratory action and bought their car before April 31, 2015, and who are subject to German law, were able to participate in the comparison, as explained by Jutta Gurkmann of vzbv. Federal Consumer Protection Minister Christine Lambrecht (SPD) emphasized: “It has been impressively demonstrated that consumers can also be compensated quickly and easily through a friendly solution to the declarative action model.”
While the claims of the participants in the model declaratory action are resolved by comparing diesel, there are still tens of thousands of customers who are privately litigating against VW. For the first time, said individual lawsuit will also be heard in the Federal Court of Justice (BGH) on Tuesday (May 5). A man from the Rhineland-Palatinate is demanding from Volkswagen the full purchase price of € 31,500 for the used car he bought in 2014. In the summer, new appointments will be made for claims for reimbursement due to diesel vehicles tampered with at BGH.
The late ramifications of the diesel scandal are also being negotiated in the Court of Justice of the European Communities (Case C-693/18). The expert responsible for the ECJ on Thursday considered that the software used to reduce the values of exhaust gases in laboratory tests is a “shutdown device” and, therefore, is prohibited by EU legislation. A judgment on this should follow in a few weeks.
In XETRA trading, VW’s share finally fell 3.83 percent to EUR 128.22.
