Before Judge 29 with the function of guarantee control, the patrolmen Harvy Damián Rodríguez Díaz and Juan Camilo Lloreda Cubillos, linked in the murder of Javier Ordóñez, which occurred on September 9, in Bogotá, were declared innocent.

In a virtual hearing and in a reserved manner, the Prosecutor’s Office charged them with the crimes of homicide and aggravated torture, after at dawn this Saturday, the delegate of the Judicial Branch declared legal the raids and procedures that led to the capture of the uniformed .

Although it was expected that the procedure would be public, at the request of the Prosecutor’s Office, support of the Public Ministry and defense lawyers, the judge declared that it was reserved. In a statement issued this Saturday the judge notified the determination.

“The 29th criminal judge with the function of Control of Guarantees ordered the non-publicity of the continuation of the concentrated hearings (…) determination adopted since the representative of the Prosecutor’s Office raised a request to continue with the concentrated hearings in a reserved manner,” said the delegate.

Although, the most recent ruling of the Constitutional Court allows the media to access said proceedings, except when there is a minor involved, is of national security, the victims are endangered or are in danger. investigation risk, the judge considered that this last action could be seen flawed.

“The head of the office acceded to the petition every time she found just cause, insofar as the facts are recent, the Prosecutor’s Office is still in the process of collecting material evidence and in the subsequent proceedings an evidentiary discovery will be made, which may compromise the success of the investigation ”, he argued in the document issued.

Thus, with the explanation and determination of the judge, she continued with the proceedings and within the framework of the same, the lawyers of the police officers did not skimp on intervening to raise a possible conflict of powers, that is, their intention is that the Military Criminal Justice know of the process.

Experts in criminal law, assured that this action cannot be provided because the crimes handed down to the uniformed men are far from the offenses that they can commit in the act of service. Thus, with such precedent, said jurisdiction could not hear the file.

In addition to this, it is important to say that even though the Prosecutor’s Office had not decided to call charges and request the security measure in prison for the uniformed men, the military criminal had already forwarded the information they had in their possession about said process .

The case

It is worth mentioning that the police patrols are before the judicial platforms for the events that occurred at dawn on September 9, with the law student Javier Ordóñez, who was severely beaten in the framework of a police procedure after he talked with some friends who turned out to witness his death.

Ordóñez, being on the floor, on more than one occasion the taser was activated against his integrity, while he implored them to stop doing it. After this action, the man and his friend were transferred to the Villa Luz Immediate Attention Center in Engativá, where, apparently, they continued to beat the deceased today.

The story of one of his friends realizes that when they saw Ordóñez’s state of health, they alerted the members of the Police, so that he was transferred to a health center, however, once they arrived at the place, the man collapsed in his chair wheels and minutes later the doctor says he arrived without vital signs.
