The Constitutional Court reported in the last hours that it declared four articles of Legislative Decree 678 of 2020 unenforceable, including two that allowed benefits such as the tax ‘Megapapayazo’ in Cali.
It is a standard issued by the National Government within the framework of the economic, social and ecological emergency decreed by the covid-19 pandemic in the country, which establishes the measures for tax, financial and budgetary management of territorial entities.
Although the court declared the decree law constitutional, it indicated that articles 2, 6, 7 and 9 do not conform to the National Constitution.
Two of these sections, 6 and 7, allowed territorial entities to offer relief for taxpayers. While the first facilitated to governors and mayors “defer the payment of taxes, without interest from territorial entities, up to 12 monthly installments,” the second “established alternatives for the territorial entities to recover the portfolio to allocate these resources to health care.”
It declared unenforceable article 2 that empowered the governors and mayors to carry out additions, modifications, transfers and other operations in budgetary matters.

The foregoing implies that measures such as the ‘Megapapayazo’ tributary of the Mayor’s Office of Cali are dropped.
