A judge denied Red Papaz the tutelage with which it sought to protect the fundamental rights of children and adolescents, violated with the closure of schools and early childhood care homes of the ICBF.
A couple of weeks ago, the Network of Parents and Mothers, Red Papaz, had presented a tutela against the National Government at the head of the Ministry of Education, the Colombian Institute of Family Welfare (ICBF), the Secretary of Education of Bogotá and the Secretary of Education of Cundinamarca. The idea was that they order the immediate return to face-to-face classes of boys, girls and adolescents from public schools (You may be interested in: A year without schools)
However, today it was learned that the guardianship was denied by Judge Stella María Osorno Bautista, of the Sixth Labor Circuit Court in Bogotá. The reason? In their eyes, the action presented by Red PaPaz is inappropriate.
With this action, Red PaPaz sought, among other things, to order the Nation, at the head of the Ministry, and the secretariats, “to carry out all the necessary actions to initiate within the shortest possible term, and in no case exceeding thirty (30) days the provision of the face-to-face educational public service in the modality of alternation in a universal and simultaneous way in all educational institutions ”.
Likewise, they wanted them to order the “Administrative Department of the Presidency of the Republic (DAPRE) and the Colombian Institute of Family Welfare (ICBF)” to carry out all the necessary actions to start the provision of comprehensive care services for early childhood of face-to-face, universal and simultaneous form ”.
“The remote delivery of these services has been completely deficient. The weight and height record, the nutritional status records and the vaccination follow-up have been lost ”, they assured in the document. Furthermore, they insist that the remote provision of these services is not adapted to the reality of families.
On the other side of the coin, today the Ministry of Health and the Ministry of Education, requested, through a circular (026 of March 31, 2021), to maintain the opening of educational institutions and face-to-face classes, of according to the guidelines established by the Government.
