Eduardo Pulgar: Court rejects request to be sheltered with home detention due to illness – Courts – Justice

The Supreme Court of Justice rejected a request made by the defense of the suspended Senator Eduardo Pulgar, who is in La Picota prison for allegedly attempting to bribe a judge, and had requested to be sheltered with house arrest.

The defense, led by lawyer Jaime Granados, had stated that Pulgar is ill and that is why the intramural detention should be replaced by ‘house for prison’.

The high court studied that petition as well as the concept that Legal Medicine delivered. According to this concept, the Court concluded, Although it is true that Pulgar is ill, his condition does not prevent him from being detained in a jail.

Thus, Pulgar will remain in prison in La Picota, a prison to which he was transferred on December 5 and in which he was reviewed. Although the lawyer Granados said at the time that the senator’s condition “makes him prone to multiple and serious diseases”, for which he requested that he be allowed to be imprisoned “in a place that does not endanger his life”, for the Court , as told by Forensic Medicine, Thumb is not in serious health condition.

Pulgar, who was suspended by 64 votes in the Senate Plenary on Tuesday, was captured on December 3 at the El Dorado airport by order of the High Court’s Chamber of Instruction, which has been investigating him since August this year.

The Court investigates Pulgar for three crimes, but resolved the legal situation against him and ordered his arrest specifically for two acts of alleged influence peddling.

(Also: The crime for which Eduardo Pulgar was arrested).

The first case of influence peddling for which his legal situation was resolved has to do with the complaint made by journalist Daniel Coronell, who published a series of audios in which Pulgar is heard allegedly trying to bribe a judge with “200 bars” for him to favor his friends and political backers in a judicial decision.

The second case of alleged influence peddling has to do with a situation in which the senator allegedly tried to make representations to the Ministry of Education and public officials in order to get that portfolio to perform improper actions.

On the other hand, this Tuesday the Council of State also ruled on the disciplinary case brought by the Attorney General against Pulgar.

Although the lawyer Jaime Granados He had raised a conflict of jurisdiction, stating that the Public Ministry could not hear the disciplinary investigation against the legislator, Rather, this process had to be carried out by the Ethics Commission of Congress, the Council of State agreed with the Attorney General’s Office in that this body is the only one empowered to take this case.

This, because the facts for which Pulgar is being investigated have nothing to do with his status as a congressman rather, they are related to alleged cases of corruption.
