Former Guajiro Governor is charged with irregularities in hiring the PAE

A delegated prosecutor before the Supreme Court of Justice imputed the former governor of La Guajira José María Ballesteros Valdivieso, due to alleged irregularities in the hiring of the School Food Plan (PAE) and the transportation service for students.

The Office of the Attorney General of the Nation identified a possible patrimonial detriment of more than 13,200 million pesos. The ex-president would answer for the contract crimes without compliance with legal requirements, in competition with embezzlement in favor of third parties.

According to the accusing body, Ballesteros was presented before a magistrate of the Superior Court of Bogotá as part of a new process that is being followed by these alleged hiring irregularities during the period in which he was in office between June 2014 and December 2015.

It was indicated that the facts investigated are related to alleged anomalies detected in the processing, celebration and settlement of two contracts.

One of the contracts was for the execution of the School Food Plan (PAE) in the department, signed a contract with the consortium ‘Nutriendo Escolares de La Guajira, on March 19, 2015. This was intended to the provision of supplements in the morning and lunches for pre-school, primary and secondary students of the 15 municipalities, for 125 days.

An addition was made to this contract, with which the total value amounted to $ 41,064,418,760.

“Throughout the process, there would have been multiple inconsistencies, among these, 11 alleged deficiencies in technical and pricing studies that, apparently, they did not support the costs, the number of planned rations, the institutions and the number of students benefited, among other aspects, ”says the Prosecutor’s Office.

It adds that it was also evidenced that there was no prior consultation with the indigenous peoples, nor were there adequate conditions and places for the students to eat their meals, therefore, in many cases They did it in classrooms, standing up, on the floor, or outdoors.

In the research it was established that for each morning supplement $ 1,759 were paid, a figure higher than that stipulated by the Ministry of Education, which was $ 971, while lunch was paid at $ 2,097, being $ 1,320 for the ministry.

The other contract questioned by the authorities was signed on May 6, 2015 with the ‘Unión Temporal Anas Watta Kai’, and sought to guarantee the provision of the school transport service for low-income children. Its value amounted to $ 9,310,604,160, with an execution period of 88 days.

“For the Prosecutor’s Office, in this process another bidder who had the capacity to cover the object of the contract was disqualified and, through different actions, presumably the temporary union was favored. The test material indicates that apparently there were no prior rigorous studies on the number and type of necessary vehicles, neither the institutions or students to cover ”, assures the entity.

He says that it was striking that municipalities outside the coverage of the department and the spring of other governorates, such as El Paso (Cesar), located 367 kilometers from Riohacha, capital of La Guajira, were included in the provision of the service.
