Woman who ran over is sentenced to serve

The São Paulo court sentenced the nutritionist Gabriela Guerrero Pereira, who ran over and murdered the business administrator Vitor Gurman, to three years in prison, under an open regime. The sanction was replaced by the rendering of services to the community and a fine in the amount of twenty minimum wages (R $ 22 thousand). The case occurred in July 2011 in the Vila Madalena neighborhood, in São Paulo.

The decision was made yesterday by Judge Valéria Longobardi. Below is an excerpt from the sentence:

In view of the foregoing, I consider the action to convict Gabriela Guerreiro Pereira, to the penalties of 03 (three) years in prison, under the open regime, referred to in Article 302, paragraph 1, subsection II, of the Law on Brazilian traffic. Code, replaced by corporal punishment by two restrictive rights, namely, a penalty for providing services to the community to be compliment within the same term of the now superseded corporal punishment and a fine in the amount of 20 Twenty) minimum wage, to be allocated to entities with a social destination as determined by the Criminal Enforcement Court, the possibility of deducting the fine for the amount of compensation already paid to the relatives of the victim Vítor is prohibited. Gurman, 24, was walking on the sidewalk of Rua Natingui, in Vila Madalena, when he was hit by a Land Rover. After hitting the boy, the car also tipped over a light pole and rolled over. Operated at dawn on July 23, 2011, he could not resist.

In 2017, the TJ-SP (São Paulo Court of Justice) decided that Gabriela would not go to the popular jury. His conduct has been reinterpreted as homicide (when there is no intention to kill).

According to the Twitter Rogério Gentile, the Public Ministry affirms that Gabriela was driving at an incompatible speed, between 62 km / h and 92 km / h, with traffic signs on the road indicating that the maximum allowed was 30 km / h. The Prosecutor’s Office also says that the nutritionist was under the influence of alcohol. Gabriela’s defense says that the nutritionist was not drunk and was not driving fast.
