With Flamengo’s request to postpone the match, the STJD (Superior Court of Sports Justice) now has a protocol to follow and make the decision to keep the match against Palmeiras, next Sunday at 4pm.

The Court has already given 24 hours for CBF to manifest itself and indicate the reasons for the rejection of the Rio club. With the signature of the director of competitions, Manoel Flores, the entity that deals with national football will send the same arguments that it sent to Flamengo.

The main one is isonomy. Other requests for postponement due to a covid outbreak, such as the one published by this Caldas blog, have already been analyzed and denied. In addition, CBF maintains that Flamengo can fill its roster, despite 16 absences due to illness and other injuries.

To register for the Brasileirão, the Gávea team only needs to choose the athletes from their base categories who are already in the BID (Daily Newsletter) and inform the CBF that they will compete in the Nacional.

There is no bureaucracy as in the case of hiring athletes from other teams, when those involved need to send documents, contracts and wait for their publication in the CBF system until a specific period before the match.

The fact that Flamengo has a team to play for Libertadores next week also influences the decision.

The STJD still recommends listening to other interested parties in your judgment. In this case it would be Palmeiras, which has already stated that it is against postponing the match. It is important to note, however, that listening to the São Paulo group is an option of the Court and not an obligation.

In the case between Caldense and Brasiliense, the STJD ratified the CBF’s decision and agreed with the arguments presented. The expectation of specialists in sports law is that this decision be upheld.

Still using the case of Series D as an example, the STJD ratified the match on the same day of the game and one day after the decision issued by CBF.
