“Justice decides, we have to comply. I read the judge’s sentence and as a lawyer I was sad, because there is no reason to convince us. So we have to comply, there is no other alternative ”, said the mayor.

The maintenance of the most restrictive measures of the Conscious Mines plan is necessary for the Health system to reestablish its capacity to assist the population. Varginha adds, according to a bulletin released on Monday, 7,666 confirmed cases, with 149 deaths, 7,112 recovered and 69 hospitalized (38 in the Infirmary and 31 in the ICU).

Among the measures of Onda Roxa are the restriction of the movement of people, especially from 8:00 p.m. to 5:00 a.m., the closure of all non-essential commerce and the expansion of the inspection carried out jointly by the municipal guards and the Army . Non-essential trade

The municipality must suspend all services, businesses, activities or undertakings, public or private, that are not essential.

Delivery

The operation of bars and food delivery restaurants in the purple wave is allowed, even after 8 at night, provided that the prohibition of local consumption is complied with, aimed at combating crowds. Other activities for the delivery of essential items, such as the delivery of medicines, are also allowed at any time of the day.

Non-essential delivery services, such as clothing and accessories, are allowed during the purple wave, but must be restricted to the period of 5 am to 8 pm.

Health services

The health sector as a whole represents an essential service, which is allowed to operate on the purple wave. However, elective surgeries (which are not essential and / or urgent) are suspended in the public network and in the private network insured by the SUS, and are not recommended in the rest of the private network.

Physiotherapy, for its part, is framed in essential health activities and, therefore, can work on the violet wave, provided it is in accredited physiotherapy clinics or at home, and applied by a physiotherapist. In the same way, Dentistry, Psychology and other branches of the health of the body and mind can also work.

Academies

Although the undeniable importance of fitness activities for health is recognized, these activities (Pilates, gymnastics, gymnastics classes, among others) will not be allowed in the purple wave, since they are not understood as essential in a quarantine situation.

Pharmacy

Pharmacies can operate on the violet wave, at any time of the day. Therefore, the activity of the pharmacist, internal to the pharmacy, to assist and guide the customer is also allowed, regardless of the schedule. In Varginha, pharmacies are expected to be available on weekends as usual.

Food

All activities related to the provision of food to citizens are allowed, taking into account the importance of food, regardless of the time.

The operation of all food marketing establishments is allowed, such as: hypermarkets, supermarkets, markets, butchers, fishmongers, fresh products, bakeries, greengrocers, food supply centers, convenience stores, snack bars, mineral water stores and food. Street stalls that sell food are also part of this permit.

Candy stores, confectioneries or even alcoholic beverages are also allowed, since they sell items considered food products, in accordance with the national regulations of Sanitary Surveillance and the Ministry of Agriculture and Livestock.

Bus (municipal and interurban))

The circulation of all public transport is allowed, but it is recommended that it does not exceed half the capacity of seated passengers. It should be noted that such transports may eventually be stopped by a health barrier or a health inspection operation, in order to prevent the entry of people with flu-like symptoms into certain regions. In fact, companies in the industry have already published since 2020 the recommendation that people do not travel when they have flu-like symptoms.

Taxi and mototaxi

Public transport services, although operated by private companies, are expected to continue operating on the purple wave. Such a measure is necessary to enable various essential services and the home’s own isolation.

Uber and the like

The transport of individual private passengers, requested by applications or other network communication platforms, is allowed during the purple wave.

Real estate

As these are not essential activities, with serious consequences related to the temporary interruption of service, real estate companies cannot operate with their doors open during the violet wave.

Churches

Considering the constitutional guarantee of the free exercise of religious cults (provided for in Art. 5, subsection VI, of the Federal Constitution, which establishes that a commercial license is not necessary for the places that carry out these religious activities), Deliberation 130 did No enter the heading of religious services between the list of permits.

It should be noted, however, that operating establishments must maintain sanitary guidelines during the pandemic, especially with regard to overcrowding. The practice of religiosity is recommended individually or shared remotely with religious groups.

Malls

Shopping malls and shopping centers in closed environments will not be able to function during the purple wave. The ban applies even to establishments that sell basic products, such as pharmacies, but are located within shopping centers.

There are reservations for establishments that sell basic necessities that have individual access to the street, regardless of the shopping center.

Home care

Only housekeeping activities, such as babysitting and cleaning, are allowed during the purple wave. Other activities, such as hairdressing and manicuring, are not allowed even at home while the restrictions last.

sports

Sporting events, although without an audience and with television broadcasting, are temporarily suspended.

Public Bodies

During the duration of the purple wave, the operation of the direct and indirect state public administration will be disciplined by the State Planning and Management Secretariat (Seplag), with the aim of guaranteeing the continuity of public services and protecting the health of the public servers. .

The municipal and federal bodies and entities located in the territory of the state are governed by their own rules, respecting the protocols provided in the Conscious Mines plan. Each public body has the prerogative to administer itself, in accordance with the minimum necessary health protocols.

Sanitary barriers

The sanitary barriers are measures to be applied by the municipalities, with the assistance of the Security Forces. The goal is to limit the movement of people in non-essential activities, directly and indirectly. In addition, health barriers are educational in nature, as offenders may be penalized.

Sanitary barriers do not need to be applied in a specific place in the city, and they do not necessarily have to divert or impede the flow of traffic. The decision on where and how to use sanitary barriers rests with the municipalities, based on their own analysis and the inputs available. Regardless of the format, the use of PPE and the adoption of other sanitary measures are required.

Surveillance

The responsibility for inspection is shared by various bodies, at the state and municipal level. Situations of notorious non-compliance with Deliberation measures 130 must be reported to local detachments of the security forces, such as the Military Police.

Security forces are trained to approach and investigate crimes, and the inspection will also seek to be educational, where possible.

On weekends the inspection will intensify, due to social issues that favor crowds. The PM will redirect part of its human resources that work in internal activities to a police display on weekends.

Penalties

The sanctions are provided in Resolution 130 for non-compliance with the restrictions imposed by the violet wave, such as warning, educational sanction, suspension of the sale of products and a fine, which will be applied according to each case. The legislation establishes that:
