TST accepts appeal from CBF and confirms achievement Palmeiras x Flamengo – 09/27/2020

Today the match between Palmeiras and Flamengo will be played at Allianz Parque, for the Brazilian Championship. In a last minute twist, the Superior Labor Court (TST) accepted a request from CBF and reversed the decisions of the Rio de Janeiro Regional Labor Court (TRT-RJ) that had decreed the postponement of the game. Both teams are in the stadium, but the match, originally scheduled for 4pm, will start late.

The TST decision reached the two preliminary injunctions of the TRT-RJ that had suspended the game at the same time. The two actions were requested by unions: the first by Sindeclubes (Union of Employees in Sports Clubs, Federations and Confederations and Professional Athletes of the State of Rio de Janeiro), the second by Saferj (Union of Soccer Athletes of the State of Rio de Janeiro ). This second, incidentally, had prohibited Flamengo from playing, traveling and training for 15 days.

The main argument of the decision that frees the confrontation is territorial: given that the exit is in São Paulo, the Rio de Janeiro Regional Labor Court would not have, according to Minister Vieira de Mello Filho, jurisdiction and jurisdiction to determine the suspension.

With a coronavirus outbreak affecting more than 40 people at the club, including 19 players, Flamengo twice tried to postpone the match in the Superior Court of Sports Justice (STJD), without success. The game was only postponed by the ordinary Justice, at the request of the unions; Sindeclubes, in fact, is chaired by an employee of Rubro-Negro.

Meanwhile, CBF kept up the legal fight to reverse the TRT-RJ decisions and keep today’s party. After having requested a competition ruling denied by the Superior Court of Justice, the confederation finally managed to appeal to the TST, which revoked the precautionary measures within minutes of the scheduled time for the start of the game.
