Candidate for reelection, Crivella was ineligible for the next six years by decision of the Rio Regional Electoral Court (TRE-RJ), at the end of September. The mayor’s defense appealed to the TSE.

TRE-RJ understood that there was an abuse of political power when, in an act of the Municipal Cleaning Company (Comlurb), the mayor’s son, Marcelo Hodge Crivella, was presented as a candidate for deputy.

Accepting the defense appeal of the mayor, Minister Mauro Campbell said that the sanction of ineligibility is “very personal.” Therefore, according to the minister, there must be “solid evidence” that the defendant actually committed the irregularity, which, for the minister, did not happen.

“As is known, the penalty of ineligibility […] it is very personal in nature and, therefore, requires, for its application, solid evidence that the agent has actually contributed to the abuse, the mere conclusions derived from the support for the sympathizers not being sufficient, ”Campbell wrote.

In a statement, Crivella said that the TSE decision “did justice” and that there was no abuse of power in the Comlurb event, as her son lost the election.

“Two years ago I went to a meeting of my son, with 50 people, which was already being investigated by the CPI of the Chamber, and they acquitted me, but had given me ineligibility. A strong, tough, very tough measure, just to go to a “My son lost the elections. What is the abuse of political power if the candidate loses? So there is no evidence, there is no gravity, there is no scale,” said Crivella .
