The current mayor is running for re-election against Eduardo Paes (DEM) – the second round is scheduled for the 29th.
Crivella had been declared ineligible for six years by the Rio Regional Electoral Tribunal (TRE-RJ), at the end of September, for abuse of political power (see details below). The mayor’s defense appealed to the TSE and, in a provisional decision, managed to suspend the disqualification sanction.
Crivella had already obtained a preliminary decision from the TSE to maintain the candidacy
The sentence of the case occurs, now, in the virtual plenary session of the TSE. In this modality, the ministers only cast their vote in an electronic system, without debate or physical meeting. Voting ends at 23:59 on Thursday.
The provisional decision that authorized Crivella’s candidacy was issued by Minister Mauro Campbell Marques, rapporteur of the case.
Until now, three of the other six ministers Sérgio Banhos, Alexandre de Moraes and Luís Felipe Salomão had already aligned themselves with Campbell’s vote.
Minister Edson Fachin did not agree with the rapporteur, but for procedural reasons.
TRE-RJ had defined Crivella’s ineligibility by 7 votes to 0 in September. The judges assessed that there was an abuse of political power when, in an act of the Municipal Cleaning Company (Comlurb), the mayor’s son, Marcelo Hodge Crivella, was presented as a candidate for deputy.
TRE-RJ unanimously approved Crivella’s ineligibility in September
The meeting was held in the Estácio de Sá court with employees of the city’s urban cleaning company. The group was transported in official company cars.
The lawsuit was filed by the PSOL and the Regional Electoral Prosecutor (PRE). Affirm that:
- Official vehicles were used to transport Comlurb employees during working hours;
- Crivella thanked the president of Comlurb for helping his candidates;
- The candidate Alessandro Costa asked the mayor’s son for votes.
