TRE-RJ resumes the trial and unanimously approves Crivella’s ineligibility | Rio de Janeiro

Judge Vitor Marcelo Rodrigues had asked for opinions to analyze the case, arguing that he had little time to hear the trial. He was nominated at the TRE on the 31st by President Jair Bolsonaro (no party).

The newly appointed defense attorney, Rodrigo Roca, requested a point of order at the beginning of the session, which was not granted.

“The sentence is null by the restriction of the defense, since the lawyer could not use the word even in order, as is his prerogative,” he said.

The mayor is a candidate for reelection and, according to the Regional Electoral Court, is not eligible in this election, unless the situation is reversed in some higher instance, such as the Superior Electoral Court or the Federal Supreme Court.

Sources heard by GloboNews believe that the mayor should obtain a precautionary measure at higher levels, which would give him the right to run. The defense says it will appeal and understands that it can participate in the elections.

The ineligibility lawsuit refers to an event in Comlurb in which Marcelo Hodge Crivella, Crivella’s son, was presented as a candidate for deputy.

Crivella’s new lawyer, Rodrigo Roca, will also ask about Judge Gustavo Teixeira’s suspicions. He, according to the mayor’s defense, is a lawyer for Lamsa, a concessionaire of the Yellow Line that lives a legal war with the City Council.

Crivella’s management determined the takeover of the Yellow Line and reduced the collection of tolls.

Crivella’s new defense works on three fronts:

• more time to analyze the process
• suspicion of one of the judges
• originality of the decision in case of conviction, considering that it should not be ineligible

Prosecutor Silvana Batini requested that the trial certificate be made urgently. The rapporteur judge Cláudio Dell’Orto also requested immediate communication of the electoral sentences, including those responsible for the rejection of candidacies.

The meeting in which Crivella is accused of abuse of political power and prohibited conduct took place on the Estácio de Sá field with employees of the city’s urban cleaning company. The group was taken away in official Comlurb cars.
