The discussion had been suspended on Monday, when six of the seven members of the TRE had already declared in favor of the punishment. – The ordinary appeal in the TRE has immediate effects. It is not necessary to have a prior analysis in full or wait for the sentence to be published – says the lawyer specializing in electoral law, Alberto Rollo Filho.

The TRE session took place amid a controversy with the mayor. On Wednesday, Crivella challenged the vote of one of the court members, attorney Gustavo Alves Teixeira, who has already cast his vote. For the mayor, Gustavo should have declared himself prevented, because he works for the office that advises Lamsa, the concessionaire that operates the Yellow Line. Crivella fights a legal battle to take Lamsa.

Crivella’s thesis had been questioned before by members of the TRE itself. A petition from the defense regarding the state of Gustavo Teixeira was analyzed by the Court before the start of the trial on Monday and, unanimously, the appellants agreed that there was no impediment.

Teixeira explained that he even declared himself impeded in another process that involved the mayor of Rio, due to his work with the concessionaire Línea Amarilla, but that, after a new analysis, he considered that “there was no inclination by any of the parties.”

The trial refers to an episode that occurred in 2016, when Crivella participated in an act on the Estácio de Sá field when he asked for votes for his son, Marcelo Hodge Crivella, who was a candidate for federal deputy.
