Minister Dias Toffoli, of the Federal Supreme Court (STF), authorized the Federal Police to collect the testimony of the Minister of Education, Milton Ribeiro, on a possible crime of homophobia.
Toffoli determined that Ribeiro be heard before a possible decision on the request to open an investigation to investigate the case.
Last month, the deputy attorney general of the Republic, Humberto Jacques de Medeiros, asked the Supreme Court to initiate an investigation based on an interview by the Minister of Education with the newspaper “O Estado de S. Paulo”.

The deputy attorney general claims that the minister made derogatory statements to people with sexual orientation of the same sex. And he adds that Ribeiro, at the time, made statements that were offensive to the dignity of the aforementioned social group.
PGR asks the STF to investigate whether the Minister of Education committed homophobia
According to the Attorney General’s Office (PGR), statements can characterize a crime by inducing or inciting discrimination or prejudice.
The interview that motivated the PGR’s request was published on September 24. Asked by the newspaper about sex education in the classroom, the minister said that it was an important issue to prevent early pregnancies, but considered that there was no need to discuss gender or homosexuality issues.
“I think that the adolescent, who many times chooses to walk the path of homosexuality (sic), has a very close family context, it is enough to do an investigation. They are maladjusted families, some of them. The father lacks attention, the mother he lacks attention. I see 12, a 13-year-old boy who chooses to be gay, has never been with a woman in fact, with a man in fact, and walking. They are questions of values and principles, “said Ribeiro in the interview.
The PGR requested that one of the first measures of the investigation be Ribeiro’s statement to the PF.
Toffoli considered that it is up to the PGR to make a preliminary assessment and the deposition can help the Public Ministry to adequately form its sentence.

After the interview, Ribeiro has said that he never intended to discriminate or encourage any form of discrimination based on sexual orientation. The minister said that excerpts from the speech, taken out of context and with partial omissions, were reproduced on social media, compounding the misinterpretation.
Milton Ribeiro also apologized and declared respect for all Brazilian citizens, regardless of their sexual orientation, political or religious position.
