TJPR acquits judge who cited black defendant’s race when sentencing him to prison

The Special Organ (OE) of the TJPR (Court of Justice of Paraná) closed the disciplinary process against Judge Inês today Marchalek Zarpelon, of the 1st Criminal Court of Curitiba (PR), which cited the race of a black accused when sentencing him to prison. The judges blamed the press for the repercussions of the case and argued that the sentence was taken out of context.

“It seems that neither the lawyer in the case nor the press read the judge’s sentence of more than 100 pages. Why If they had read the sentence, as we all read, they would have reached the same conclusion as the eminent magistrate, in the sense that there is no racism, ”said Judge Fernando Paulino da Silva. Natan Vieira da Paz, 42, was sentenced to 14 years and 2 months in prison for the crime of theft. In the sentence handed down last month, Judge Inês Marchalek Zarpelon wrote:

Nothing is known about his behavior. Certainly a member of the criminal group, because of his race he acted in an extremely discreet way, and his behavior, along with the others, caused the discomfort and hopelessness of the population, so it must be valued negatively.

During the TJPR session, the judge’s lawyer, Francisco Zardo, argued that the defendant’s sentence was not increased because of the color of his skin, but because of his conduct. According to him, the proof that there was no racism is the fact that the sentences of the other defendants were also increased, although in the case of the other Inês he did not mention that they were white.

“The clear proof of this is that the sentence also considered the conduct of all the other members of the organization as unfavorable circumstances, raising the base sentence of all, and did so in the same proportion. The section ‘for your race’ is not subordinate to the previous sentence, but to the subsequent sentence ”, he argued.

Judge Clayton Maranhão also suggested that there was a lack of interpretation by critics of the function of the comma and sentences.

“For some time, the comma is on the bench. This case is not the first case, unfortunately it seems that it will not be the last,” he said. “It seems like people are too lazy to read, but not too lazy to go out and attack people on social media.”
