The Federal Justice of São Paulo determined yesterday that the Union must inform on the website of the Ministry of Health about the effectiveness, or not, of the speech presented by Pastor Valdemiro Santiago, of the World Church of the Power of God, that the cure of COVID-19 is viable through the bean seeds it sells. The folder has 15 days to include information on the portal.
In May, the pastor posted videos on YouTube announcing the sale of bean seeds with healing properties for the new coronavirus for up to R $ 1000; the items were sold on the church’s website.
The MPF (Federal Public Ministry) alleges that there was an “abusive practice of religious freedom” and requested that the videos be removed from the air. The agency also asked the Ministry of Health to include in its site that the news spread by Valdemiro was about fake news. Initially, the portfolio adopted the request and included a notice on the portal. However, the warning about fake news was removed from the air on the grounds that the initiative led to “questioning the faith and beliefs of a part of the population.”
In the sentence published yesterday, federal judge Tiago Bitencourt de David, of the 5th Civil Court of São Paulo, stated that “informing is not hindering a profession of faith or preventing people from making the decisions they deem pertinent.”
Therefore, the Ministry of Health must present to Brazilians how it has acted and what are the prevention and recovery options that are already scientifically supported and those that are not. And the bean case has become so expressive that there is no way to stop addressing it, so much so that the Ministry of Health itself had already spoken out about it, so ignoring the issue is no longer an option given the scale of the problem. a fact that has even been widely publicized on the Internet

The magistrate argued that if a person wants to spend his money in one way and not another, “that is his business” and that it is not for the State to say “that he is ignorant and does not know how to make good decisions.” For this, he added, the State has the duty to inform its citizens about the means of prevention, promotion and recovery of health so that people can decide freely and spontaneously.

It determined that Google must preserve the videos in their entirety, even if they are taken off the air, and that they submit the registration data of the person responsible for posting to the platform within 30 business days.
Also in 30 days, according to the decision, the Ministry of Health must inform who determined the withdrawal of the information, the site of pasta, on the lack of effectiveness of the seeds in the fight against covid-19. However, he asked not to use the term fake news for being “a foreignerism that does not have a legal category and whose use may conceal an attempt to invalidate an opinion different from that defended”.
In the videos, Pastor Valdemiro even cited the case of a believer whose full recovery from the disease using beans would be proven by a medical certificate. The WHO (World Health Organization) and Anvisa (National Health Surveillance Agency), as well as the Ministry of Health, do not recognize the effectiveness of any drug in the treatment of the new coronavirus.
The MPF filed a lawsuit asking Valdemiro and the church to pay R $ 300,000 in compensation for revealing a false cure for the virus.
