BRASÍLIA – The Prosecutor of the Federal Court of Accounts (TCU), Lucas Rocha Furtado, asked the Court to determine, on a precautionary basis, that Petrobras should not carry out any activity related to the management of the company until the body that judges whether the President Jair Bolsonaro interfered with the state company.

The company’s Board of Directors meets this Tuesday to evaluate the replacement of the current president, Roberto Castello Branco, by General Joaquim Silva e Luna, current leader of Itaipú, announced by Bolsonaro last week, among other issues.

The request also extends to President Jair Bolsonaro’s decision to lower federal taxes on cooking fuels and gas without pointing out where the revenue would come from to cover this tax break.

Evidence of ‘overlapping private interests’

In the opinion of the Prosecutor’s Office, the measures taken by President Bolsonaro are indications of “overlapping of private interests for electoral purposes on the public interest and deviation from the purpose of the administrative act, violating the constitutional principles of legality and morality,” says an extract from the petition.

Furtado asks TCU to evaluate the reasons for the replacement of the president of Petrobras, Roberto Castello Branco, by General Joaquim Silva e Luna, announced last Friday through Bolsonaro’s social networks.

He also questions the reasons for the cut in federal taxes on cooking gas and diesel, in addition to carrying out a prior check to find out Bolsonaro’s interests when he says that he will “stick his finger in electricity.”

“My concern is heightened when I notice that there are signs of interest from the current government in intervening politically in other state companies,” says the prosecutor.

On behalf, Furtado concludes:

“Being present, in the case under consideration (…) to determine, for example, the Plenary of the TCU or the rapporteur of this representation, as a precautionary measure, that Petrobras refrain from carrying out any activity related to the management of the company, especially related to the exchange of people in the position of president of the state company, until the Court decides on the merits of the matter ”.

Opening of the process

The request was submitted on Monday. The next step will be the opening of a process with the TCU technical area.

In the understanding of an interlocutor, there are limits to the TCU’s performance on the conduct of the President of the Republic, since Congress is judged by the government.

He changed his tone: In a campaign program, Bolsonaro said that Petrobras should follow the fluctuation of international prices.

However, the expectation is that the measures taken by the president in the specific case of Petrobras will be analyzed in a specific procedure because there are ways to change the leadership of a state company without causing losses to the company and generating noise and mistrust. in the market and among investors.
