Minister Felix Fischer of the Superior Court of Justice (STJ) denied another appeal by Senator Flávio Bolsonaro’s defense (Republicans-RJ) that he intended to paralyze investigations into the alleged “cracked” scheme. The irregularities would have happened while he was a deputy.
The attorneys asked Fischer to reconsider his April 17 decision, which denied a habeas corpus to stop the investigations. The minister declared that the defense did not present new facts that justify a change in its position.
Flávio Bolsonaro is investigated on suspicion of embezzlement, criminal organization and money laundering in his office in the Legislative Assembly of Rio de Janeiro (Alerj).
For the STJ, the senator alleged a violation of fiscal and banking secrecy in the communication made by the Council for the Control of Financial Activities (Coaf) about its atypical movements. The Rio de Janeiro Public Ministry (MP-RJ) contested the senator’s accusations.
According to the investigative body, the appeal was unfounded. “This appeal has no logic or legal reasoning endowed with reasonableness,” part of the document said.
Now, the Federal Prosecutor’s Office and the Rio Prosecutor’s Office must speak to the STJ about the case. After this stage, the defense request must be judged by the Fifth Panel of the STJ, which still has no date.

According to prosecutors, no email requests were made to Coaf, ruling out the possibility of informal communication between the parties to obtain information on the case.

According to the MP-RJ, Flávio was Head of a criminal organization that served in his office from 2003 to 2018, when he served four consecutive parliamentary terms.

The money, according to the investigation, was laundered in a chocolate store in Rio, of which the senator is a partner and in real estate.
