RIO – Sergeant Wainer Teixeira Junior, sentenced for leading the militia that dominates Maricá, in the Metropolitan Region of Rio, obtained a habeas corpus, was released and wants to be a councilor in the municipality. On March 2, Teixeira received a sentence of five years and three months in prison from Judge Roberta dos Santos Braga, of the 2nd Criminal Court of São Gonçalo, for the crime of setting up a private militia. Just three weeks later, the sergeant benefited from a decision by Judge Roberto Távora, which determined his release. At the end of July, the agent, already out of jail, presented a candidacy for councilor for Maricá by the PSD.
In the decision that freed the sergeant, the judge cited the coronavirus pandemic, which was in its infancy in Brazil, and defended that the Judiciary, “without putting society at risk or the proper procedural progress, seek, within legal parameters, remove those who are already in condition to be released. ” The decision was confirmed in August by the Seventh Criminal Chamber. Even convicted, he remains in the Military Police, stationed at the UPP Chatuba. The agent, however, can only carry out bureaucratic activities by decision of the Court.

After his release, Teixeira entered a pre-campaign: his candidacy already has an official website and even a slogan, “Respect returns! Call and trust.” For the voters, the sergeant presents himself as a “good man”: “My father taught me to be a good man and I transmit this to my children through my example of life”, says a text published on the website .
According to the complaint from the Public Ministry that culminated in the sergeant’s conviction, the militia led by Wainer killed enemies, traffickers and drug addicts to control several neighborhoods in Maricá, such as Inoã and Itaipuaçu. In September 2018, for example, the sergeant gave the order to kill former cronies, “accusing them of treason for not transferring the money collected safely during the arrest.”
The investigation of the Civil Police reveals that, at the time the paramilitary group began to lead, Teixeira was working in one of the units of the Tactical Mobile Patrol (Patamo, in police jargon) of the 12 BPM (Niterói) in charge of monitoring Sissy.

The gang also has control over condos in the “Minha casa, minha vida” program in the city. In March 2018, five young men were executed on one of the sets. According to the police investigation, João Paulo Firmino, Wainer’s partner imprisoned for the crimes, shouted to the neighbors before the shooting: “Everyone, this is the militia, I will put an end to the disorder in the condominium.”
In addition to benefiting from the collection of security fees from merchants, the Wainer-led militia also operates the private security and surveillance service: since 2012, the sergeant owns the Equipe W company, a reference to the initial of his name, which provides a “24-hour surveillance, cameras with presence sensor and alarms” service. According to the investigation, the company dominates the market because it exploits its competitors: the group “charges 20% of the amount collected by independent security guards in places where irregular security is not directly provided by the military, such as Inoã and Itaipuaçu.”
‘Tip HQ’: Councilors wanted more power within the city council, says the deputy
Despite saying that he was implacable with the “outcasts”, Wainer responds to another process, in which he is accused of receiving bribes from traffic, when he worked in the 7th BPM (São Gonçalo), until 2016. At that time, the Sergeant was one of the agents stationed at the PM base in Jardim Catarina, denounced by the MP, after an investigation by the Niterói Homicide Police (DH), for receiving R $ 7,500 per month to stop trafficking.
The sergeant’s political claim is not new: in 2012, he was a candidate for councilor in Maricá, but he obtained 171 votes and was not elected. Four years later, he tried to run again for the same position, but the Regional Electoral Tribunal (TRE-RJ) considered him “unfit” for not having been responsible for his previous campaign. Even without being able to participate in the elections, the sergeant’s face did not leave the saints circulating in the city: posters with the face of the prime minister, the inscription “Wainer indicates” and candidates for mayor and councilor could be seen in Maricá during the 2016 election. The two nominees named by the agent were elected.
Asked about the reason why the agent remains in the corporation even when he was convicted, the prime minister stated that “there is a pending investigation procedure in the Department of Internal Affairs of the Corporation” against the sergeant. Teixeira’s lawyer, Daniel Rodrigues da Silva, in a note, affirms that the prime minister “was unjustly accused, which has already been proven throughout the process since there is no evidence against him except the summons to his name in the Third-party phone calls continue to be obtained irregularly. “

“Sergeant Wainer was unjustly accused, which has already been proven throughout the process since there is no evidence against him except to mention his name in telephone calls from third parties still obtained in an irregular manner. A habeas corpus was filed, and in a fair in the application of the Law and in defense of the Democratic Rule of Law, the Court of Justice recognized the right to freedom of the policeman. The DH Delegate of Niterói, at that time, Bárbara Lomba, in a hearing, affirmed that in no At that time, he requested the arrest and / or indicated the complaint against him, that is, the police persecution was clear. Regarding the massacre of Minha Casa Minha Vida, there is no connection between the incident and the Carabinero, who was never even investigated by such crime, and it should be noted that the alleged defendant of having committed the crime has already been acquitted of the alleged crime of militia, thus demonstrating once again the inexistence of the alleged militia of which the Police Officer Police W Ainer was accused of never having been involved in the disorder, being a correct man, defending the family, father of 4 children, having more than 20 years of service to society as a military policeman and having been honored for his work at the head of a patamo in Maricá who, with his experience and dedication, lowered crime rates in Maricá. Since joining politics, targeting policies to help minors in need and prevent their involvement in drug trafficking and fly the flag of public safety, he has suffered political persecution from people who are using false accusations to try to denigrate the image of the Political Sergeant in the City where he is known for his social actions and police services provided to the City Council and for his defense in favor of the family and public safety of the citizens of Marica and today in the PSD with a coalition of the current party Mayor Fabiano Horta has a proposal for an alliance for the progress, growth of the city and the fight against human trafficking, thus giving the peace of mind that citizens expect ”.
