The São Paulo court today sentenced security guards Valdir Bispo dos Santos and David de Oliveira Fernandes to 10 years, 3 months and 18 days in prison for whipping a teenager, tied, gagged and naked. – inside the supermarket where they worked, in the south of São Paulo, in August last year.

Both are imprisoned in Tremembé, in the interior of São Paulo. Today’s decision reformulates last December’s decision that sentenced the security guards to 3 years in prison. In the previous decision, Santos and Fernandes had been acquitted of the crime of torture. Now the courts have found them guilty of torture, bodily injury, private imprisonment, and disclosure of vulnerable nudity.

The new decision was issued by the 4th Criminal Chamber of the TJ (Court of Justice). According to the rapporteur, Judge Ivana David, “after arresting the adolescent, it was a security duty to present him to the competent authorities. Instead, they subjected the victim to intense physical and mental suffering, intentionally committing the crime of torture.”

Likewise, according to the magistrate, “there is no way to deny the imposition of moral and psychological suffering resulting from the dissemination of the images – these alone show the immense emotional shock it caused to the victim, exposed naked and gagged, spilling much of the of mere punishment “. and the humiliation already inflicted and slipping into sadism and pedophilia, indicating contempt for the human condition ”.

Without a doubt, subjecting her to intense physical and mental suffering to punish her, they committed the crime of torture quite intentionally.

In court, Valdir said the teen was detained by David, who asked for help getting him to a room at the back of the market. There, he admitted to having “spanked some” to intimidate the boy. He reported that the young man was naked, immobilized, but stated that he had no intention of torturing him.

Also in court, David denied all the charges, but said he had approached the same victim on other occasions also for petty theft.

A 17-year-old boy was attacked by the two security guards after trying to steal chocolate bars from the Ricoy supermarket, in the southern area of ​​São Paulo, in August last year. He had a history of chemical dependency and was taken in, after a series of complaints, in a shelter run by the São Paulo mayor’s office.

At the time of the arrests, the victim recognized the two police station security guards as the perpetrators of the torture. The young man reported that Valdir Santos was the aggressor and David Fernandes, responsible for the recording.

In testimony to the police, Fernandes claimed that he asked the young man to lift his shirt and found that there were between 10 and 12 hidden chocolate bars. Then he said that he called Santos and told him to take the boy to the “FLV room”, a warehouse where fruits and vegetables are kept.

After calling his colleague, the official stated that he did not see any assault and that the young man was “in the possession of Santos.” Santos denied having participated in the attacks and said he undressed the young man to search him.
