This Monday, May 11, 2020, the municipal car rotation in the capital of São Paulo becomes even more rigid. The rotation has been suspended since March 17.

The goal is to avoid unnecessary displacement and reduce the rapid growth of Covid-19 cases, which has intensified in recent weeks in Brazil.

The rules are different from those of the common rotation and still cause doubts.

WHEN WILL THIS SCHEME LAST?

Until the state of public calamity lasts in São Paulo and until the number of cases and deaths continues to grow. Mayor Bruno Covas said that if for several consecutive days the isolation rates are above 60%, the new rotation could be suspended.

WHAT VEHICLES AND PROFESSIONALS ARE EXEMPT FROM THE WHEEL?

Some vehicles and professionals that were already exempt from the common rotation will not need to perform any type of registration, but because it is an exceptional situation, some vehicles and essential service workers will also be free from the rotation, however they will need to register.

– Vehicles that MUST be registered.

In accordance with the ordinance of the São Paulo Municipal Transportation Secretariat published on Saturday, May 9, 2020, the vehicles provided for in Article 5 of Decree No. 59,403, of May 7, 2020, must be registered. vehicles belonging to:

I – health professionals, nursing professionals, health technicians or technologists, veterinarians, physical therapists, pharmacists, nutritionists, psychologists, speech therapists, pathologists, dentists, health researchers, agents performing administrative services, guard, security, surveillance , maintenance and cleaning of hospital establishments, medical assistance and laboratories, the employer’s establishment being responsible for identifying professionals and their vehicles before the Municipal Department of Mobility and Transport;

II – officials who carry out public security and administrative inspection activities, such as the military police, the civil police, the federal police, the agents of the penitentiary system, the technical-scientific police officers, the metropolitan civil guard and agricultural tax agents federal, state and municipal, the highest body of each of the respective categories is responsible for identifying professionals and their vehicles before the Municipal Secretary of Mobility and Transport;

III – officials and contractors of social services and social assistance, the Municipal Funeral Service, the Municipal Secretariat of Social Assistance and Development and the Secretary of State for Social Development that identify professionals and their vehicles before the Municipal Ministry of Mobility and Transport;

IV – professionals from press agencies, such as newspapers, radio and television, and the respective employer is responsible for identifying professionals and their vehicles before the Municipal Department of Mobility and Transport.

HOW THE REGISTRATION MUST BE DONE:

The registration will be made through the electronic filing of the form contained in the Single Annex of this Ordinance, in EXCEL, to the email [email protected], or through Portal 156. The following information must be placed in the body of the message:

  1. a) the person responsible for the qualified application: full name, RG, CPF, address, company / cell phone, cell phone and also the name of the linked establishment for eventual contact by the DOV;
  2. b) express confirmation in the body of the email that the information provided is true and that you are fully responsible for it.

The ordinance also says that only the records required by the company will be accepted and processed, not allowing the individual shipment of the professional,

The self-employed professional can also register as long as they send a document that proves the exercise of the activity.

Only forms submitted in EXCEL will be accepted and attachments cannot exceed 10 MB, being able to send as many emails as necessary, but whenever possible, put everything in a message.

CPF / CNPJ or license plate information must not contain periods, dashes, bars, dashes, or any other graphic sign other than a number or letter.

The deadline to send the email is ten days from the publication of SMT.GAB No. 092, that is, from May 9, 2020.

– Vehicles that do NOT need to be re-registered if they are ALREADY registered under the common rotation exemption:

The vehicles covered by the assumptions described in Article 4 of Decree No. 59,403, of May 7, 2020, do not need to request registration, taking advantage of the previously existing registration in the Department of Road System Operation – DSV.

These vehicles are: Art. 4 The following cases are excluded from the traffic restriction:

I – public transportation and capacity, duly authorized to operate the service;

II – motorcycles and the like;

III – taxis, duly authorized to operate the service;

IV – school transportation, duly authorized to operate the service;

V – winches, duly authorized to operate the service;

VI – those intended for fire and rescue, those for the police, those for inspection and operation of traffic and ambulances, duly identified by regulatory devices for audible alarm and intermittent red lighting;

VII – those, own or contracted, used in essential public services, considered as such, for the purposes of this decree:

  1. a) civil defense;
  2. b) the armed forces
  3. c) inspection and operation of passenger transport;
  4. d) funerals; e) penitentiary centers;
  5. f) Guardianship councils;
  6. g) social assistance
  7. h) the judiciary;
  8. i) used in the transport of materials necessary for public campaigns, including public health and civil defense, as well as in the provision of social services;
  9. j) in the safety of rail and underground transportation referred to in Federal Law No. 6,149, of December 2, 1974, as well as those for the emergency maintenance of rail and underground systems, duly identified with the names and logos of the companies supplying the services in the front, rear and sides, plus the words “maintenance” or “security”, according to the purpose of using the vehicle;
  10. k) duly identified public chemical emergency assistance companies;

VIII – those, whether owned or contracted, used in essential works and services, as defined for the purposes of this decree:

  1. a) the implantation, installation and maintenance of urban infrastructure networks and equipment, related to electricity, public lighting, water and sewerage, telecommunications, data and fuel gas by pipeline, provided that it is authorized by the competent agency;
  2. b) the implementation, maintenance and preservation of traffic signs, as well as support for the transit operation, when acting as a transit agency, provided they are duly identified;
  3. c) garbage collection, duly authorized to operate the service;
  4. d) works, maintenance and conservation of roads and public places, duly identified;
  5. e) the post office, duly identified;
  6. f) transportation of fuel;
  7. g) transportation of supplies directly linked to hospital activities;
  8. h) transportation of blood and blood products, organs for transplantation and material for clinical analysis;
  9. i) transportation of valuables, duly authorized by the Federal Police Department;
  10. j) armed escort, duly authorized by the Federal Police Department;
  11. k) reports focused on news coverage;
  12. l) transport of perishable food products, that is, any food that is changeable or unstable at room temperature, processed or not, frozen or super-frozen, or that needs to be at temperatures established by specific legislation;
  13. m) Urban cargo vehicle (VUC), van, small truck, with dimensions and characteristics suitable for the distribution of goods and supplies in the urban environment, defined in an act of the Municipal Secretariat for Mobility and Transport;
  14. n) mobile units specially adapted to provide medical services;
  15. o) maintenance and maintenance of elevators, duly authorized to provide this service;
  16. p) for the management of chemical and environmental emergencies related to transportation, duly accredited by the Municipal Secretariat for the Environment and the Environment;

IX – those, whether their own or contracted, employed in essential works and services, as defined for the purposes of this decree, those for the supply of pharmacies, hypermarkets, supermarkets, markets, street markets, butchers, fishmongers, fresh products, greengrocers, food water supply centers, convenience stores, mineral water stores, bakeries and stores specialized in the sale of medical, dental, orthopedic and hospital articles;

X – vehicles with exemption due to their own legal regime, considered as follows:

  1. a) those that run on electric, hydrogen or hybrid propulsion energy;
  2. b) those belonging to doctors, when used in daily work;
  3. c) those who belong to diplomatic missions, special delegations, consular career departments and representations of international organizations, duly registered and registered in accordance with specific provisions;
  4. d) those driven by a person with a disability resulting in reduced mobility or by those who transport them;
  5. e) those driven by a person with a chronic illness that compromises their mobility or undergoes continuous debilitating treatment for a serious illness, such as chemotherapy for cancer treatment, or by those who transport it.

Let’s remember the decree:

As a way to discourage unnecessary travel and prevent the spread of the new coronavirus, the city of São Paulo announced that a new model of municipal vehicle rotation will come into effect on Monday, May 11, 2020.

The restriction will be 24 hours a day and on all city highways, including neighborhood streets.

On even days, only vehicles with even end plates can drive, and on odd days, only cars with odd end plates can operate.

So:

Cars with thin plates 0, 2, 4, 6 or 8 can run on days 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22, 24, 26, 28 and 30

Cars with thin plates 1,3,5,7 or 9 can work on days 1,3,5,7,9,11,13,15,17,19,21,23,25,27,29 and 31.

But there are exceptions and some professional vehicle types and categories can be used. The application of the car will have to follow the rotation. Only the taxi will be exempt.

Decree 59,403, of May 7, 2020, was published on Friday (08) and “It establishes an emergency regime to restrict the movement of vehicles in the city of São Paulo due to the pandemic resulting from the coronavirus.”

Exceptions that will not be restricted include: buses, motorcycles, and the like, authorized school transportation, cranes, identified public service vehicles, identified public safety vehicles, garbage collection vehicles, vehicles for the transportation of supplies directly related to activities hospital and blood collection, transportation of values, reports aimed at journalistic coverage; transportation of perishable food products, urban freight vehicles (VUCs), vans, small trucks, electric, hydrogen or hybrid vehicles; vehicles driven by a person with a disability resulting in reduced mobility or by those who transport them; Vehicles driven by a person with a chronic disease that compromises their mobility or who undergoes ongoing debilitating treatment for a serious disease, such as chemotherapy for cancer treatment, or who carries them.

Among the professionals who will be released if they register by email or with communication from their contracting authorities are:

– health professionals, nursing professionals, health technicians or technologists, veterinarians, physical therapists, pharmacists, nutritionists, psychologists, speech therapists, pathologists, dentists, health researchers, agents who perform administrative services, guard, security, surveillance, maintenance and cleaning of hospital establishments, medical assistance and laboratories, with the employer’s establishment being responsible for identifying professionals and their vehicles before the Municipal Ministry of Mobility and Transport;

– Military Police, Civil Police, Federal Police, Prison System Officers, Technical-Scientific Police Officers, Metropolitan Civil Guard and Fiscal Agents from Federal, State and Municipal Farms

– Funeral and social service officials and contractors,

– professionals of the press, such as newspapers, radio and television, and the respective employer is responsible for identifying professionals and their vehicles before the Municipal Ministry of Mobility and Transport.

In case of non-compliance, the vehicle will be fined by the regulation of the Brazilian Traffic Code, with a fine according to the violation of rotation every day that it is caught.

  10. k) duly identified public chemical emergency assistance companies;

VIII – those, whether owned or contracted, used in essential works and services, as defined for the purposes of this decree:

  1. a) the implantation, installation and maintenance of urban infrastructure networks and equipment, related to electricity, public lighting, water and sewerage, telecommunications, data and fuel gas by pipeline, provided that it is authorized by the competent agency;

I – health professionals, nursing professionals, health technicians or technologists, veterinarians, physical therapists, pharmacists, nutritionists, psychologists, speech therapists, pathologists, dentists, health researchers, agents performing administrative services, guard, security, surveillance , maintenance and cleaning of hospital establishments, medical assistance and laboratories, the employer’s establishment being responsible for identifying professionals and their vehicles before the Municipal Department of Mobility and Transport;

The fine is the same as for not complying with the rotation.

Trucks, on the other hand, continue to be regulated by specific rules, not related to the “new launcher”.

MP WILL CHARGE EXPLANATIONS:

Prosecutors Roberto Luís de Oliveira Pimentel and Camila Mansour Magalhães da Silveira, from the São Paulo State Prosecutor’s Office, demanded that the São Paulo City Council explain in 48 hours the criteria and expected impacts for the new municipal vehicle rotation that will come into effect Starting Monday, May 11, 2020.

Civil Investigation No. 14.279.74 / 2020 wants answers to the following questions:

  1. from when will the rotation take effect and for how long is the restriction planned to be adopted;
  2. in what respects will the same regulation continue as before the covid-19 pandemic and in which aspects were there changes. In case of changes, and regarding them, the rules must be specified to restrict the circulation of private vehicles in this Capital, with details of the hours, days and final plates;
  3. They must also be informed how and through communication, the population will receive the necessary clarifications on all aspects of the measure, including to avoid new crowds and disorders in the midst of the covid-19 pandemic that the country is currently facing. ;
  4. the studies and planning that supported the resumption of the rotation, as well as, in detail, the objectives to be achieved;
  5. plan the rotation so that there is no damage to the movement of vehicles and professionals related to essential services, especially health and safety (that is, if health and safety professionals and providers of other essential services will be identified, as well as in which aspects said vehicles and professionals will be exempt from rotation and how they will be released from the measure, if applicable, to avoid inconveniences and difficulties for their circulation);
  6. in view of the news of an increase in the bus fleet due to the resumption of restrictions on the movement of private vehicles, on which the establishment of the number of vehicles (buses) available to reinforce the public transport fleet was based, that is, on the basis of which studies or planning the number of buses in circulation after the resumption of the rotation system was established, to avoid overcrowding and, consequently, to prevent the spread of the New Coronavirus on public transport.

WITHOUT DIALOGUE:

The announcement of a tighter rotation by the city created discomfort in part for the São Paulo state government.

The return of the municipal auto rotation in São Paulo, even more rigorous scheduled for Monday, May 11, 2020, was not communicated by the city to the state’s transportation managers.

That is what Metropolitan Transportation Secretary Alexandre Baldy said in an interview with TV Bandeirantes.

The concern is that many people who work in the capital of São Paulo and who currently use cars live in cities in Greater São Paulo, such as ABC, Mogi das Cruzes, Osasco and Guarulhos, for example.

According to Baldy, the estimate is that the demand for metropolitan buses managed by EMTU, CPTM trains and Metro trains, will increase from 25% to 30%, at least during peak hours.

The secretary said that he is already talking with those responsible for EMTU, CPTM and Metrô to take measures with the aim of increasing the fleet of buses and trains.

The concern is mainly with rush hours.
