The Ethics and Discipline Court of the São Paulo section of the Brazilian Bar Association notified former judge and former Minister of Justice Sergio Moro to reiterate that the practice of private law is prohibited to clients of the Alvarez & Marsal consultancy , of which Moro became a managing partner.
The document, obtained by spells, is signed by the TED president, the attorney Carlos Kauffmann.
The text warns that Moro cannot exercise private law for A&M clients, under penalty of adopting the pertinent administrative and judicial measures.
The notice also reminds that consulting firms are expressly prohibited from “rendering legal services to their clients, including legal advice and consultancy, not even by in-house attorneys, regardless of their position or function.”
Last Sunday (11/29), Moro announced that he had been hired by the North American consulting firm Álvarez y Marsal. The company is responsible for the judicial administration of Odebrecht, one of the companies most affected by the decisions of the former “lava jet” judge.
The consultancy also provides financial advice for the recovery of Sete Brasil, in addition to being hired by Queiroz Galvão to restructure the group. All these companies are in a delicate economic situation since they were devastated by the “lava jet”. The hiring generated an ethical debate among the legal community.
Recently, the The OAB rejected a request made by the Ministry of Foreign Affairs for the entity to relax the rules for the performance of foreign lawyers in the country. The position was voted in the plenary session of the Federal Council on November 5.
Shortly after announcing his hiring for A&M, Moro noted that the nature of his duties at the company is not related to private law activities. Anyway, the fence is now official.
