Legalization of abortion in Argentina

The Senate vote it should only end at dawn Wednesday (30), and, according to “Clarín”, the decision will be determined by a small margin. A survey with senators indicates that there are 33 votes in favor of legalization and 32 against. However, according to the newspaper, there were five undecided votes.

The voting margin, therefore, will be narrower than that observed in the approval of the Chamber on December 11: the bill received 131 votes in favor and 117 against by the deputies. Six MPs abstained.

In the event of a tie in the vote, the tie will be decided by the president of the Senate, the former president and current vice president Cristina Kirchner. During her tenure as head of state (2007-2015) she did not propose to legalize abortion, but changed her position and voted in favor of the measure in 2018 when Congress first examined a bill to legalize the termination of pregnancy.

It is the second time in less than three years that the issue is back on the agenda. Fernández’s government project reached Congress weeks ago, following a promise from the then opposition candidate to Mauricio Macri.

In 2018, still under the Macri government, a proposal to legalize abortion in Argentina also passed through the Chamber. However, the text was eventually rejected in the Senate.

Current law only provides for the voluntary interruption of pregnancy when there is a risk to the life of the mother or when the conception is the result of rape.

That would change if the law changes: the bill, if approved, authorizes the termination of pregnancy until the 14th week of gestation. The procedure must be carried out within ten days of the request to the health service.

The text establishes that doctors who are against abortion are not obliged to perform the procedure, but the health services must designate another professional who is willing to do so. If the patient is under 16 years of age, she will need parental consent.

What happens to pregnant women over 16 and under 18 was a matter of debate. Initially, the text said that they could request the procedure themselves. After discussion, a paragraph was added stating that, in this situation, if there is a conflict of interest with parents, patients will receive legal assistance.

In another change in relation to the original text, debated in this session in the Senate, the government promised to veto an article of the project itself that raised doubts: the passage spoke of abortion after week 14 in case of risk to “health integral “of the pregnant woman. . Legislators considered that the expression could lead to the understanding that any health-related problem could allow a late termination of pregnancy.
