STJ minister denies house arrest to accused of concealing weapons in Marielle case | Politics

Minister Ribeiro Dantas, of the Superior Court of Justice (STJ), denied the request for house arrest of Josinaldo Lucas Freitas, denounced for hiding the weapons that would be manufactured by police officer Ronnie Lessa, one of those accused of the murder of the councilor Marielle Franco and her driver, Anderson Gomes.

Freitas’ defense argued before the STJ that it would be a risk group for the coronavirus, since it is diabetic and hypertensive. Freitas has been in pretrial detention since October 2019.

For the STJ minister, the Rio de Janeiro Court of Justice (TJ-RJ) denied having removed Freitas from prison due to the complexity of the facts investigated and considering that there is no unjustified delay by the justice authorities in conducting of the case.

The TJ-RJ also considered that the Covid-19 pandemic is not a reason to, at the moment, revoke the preventive prison, since the Criminal Execution Court of Rio de Janeiro has been taking temporary measures to avoid contagion in the penitentiary system, according to the recommendations of the health authorities.

The STJ minister also mentioned that the TJ-RJ recorded that there is no medical report proving Josinaldo Freitas’ actual health situation and the possibility that any problems will be treated in prison. Submission of this documentation has already been required by the TJ-RJ and is being provided.

“Without any advance on the merits of the lawsuit, I do not foresee, at least at this time, the presence of an authoritative assumption of the granting of the requested emergency aid,” wrote Minister Ribeiro Dantas.

Martial arts teacher Josinaldo Lucas Freitas was arrested in October 2019, during Operation Submersus, by the Civil Police and the Public Ministry of Rio de Janeiro. On the occasion, in addition to him, three other people were arrested, including Elaine Lessa, the wife of Ronnie Lessa, accused of participating in the murder.

About Josinaldo, the “Djaca,” the MP-RJ notes that other investigators ordered him to dump material taken from Lessa’s department into the sea.

For this, the parliamentarian narrates that Josinaldo would have hired the services of a boatman in Barra da Tijuca and determined that the boat should go to the high seas, where weapons and other materials were discarded.

This led to the complaint against the teacher for criminal organization. At that time, the judge considered that if he was released, the accused could commit new crimes and avoid a criminal investigation.
