Minister Ricardo Lewandowski, of the STF (Supreme Federal Court), decided on Wednesday (30) to extend the state of calamity due to the new coronavirus pandemic. The request was made by the Rede Sustentabilidade party. The state of calamity would end tomorrow (31).

In his decision, Lewandowski justifies the need for an extension due to the persistence and lethality of covid-19:

“Although the law 13.979 / 2020 [de fevereiro de 2020 e que dispõe sobre as medidas de enfrentamento à pandemia] is linked to the legislative decree of public calamity for exclusively tax purposes, reiterates, expiring on December 31, 2020, it cannot be excluded, in this precarious and ephemeral sentence, typical of the present procedural phase, the conjecture according to which the true The intention of the legislators has been to maintain the extraordinary prophylactic and therapeutic measures, recommended in this normative diploma, for the time necessary to overcome the most critical phase of the pandemic, even because at the time of its publication they could not foresee the surprising persistence and lethality of the illness. . This fact, however, according to the empirical evidence, is still far from materializing. “

The request of the Network cited the health aspects of the state of calamity and limited the scope until the Legislative and Executive Powers decide on the issue, without going beyond the end of 2021 or until the end of the international health emergency derived from the coronavirus, as decided by the WHO (World Health Organization).
