STF orders to close bars, restaurants and hotels in São Paulo

Once again, the Federal Supreme Court (STF) needed to act to enforce State Decree 65,415 / 2020, which places São Paulo in the red phase of the covid-19 containment plan. This Saturday (2/1), the President of the Court, Minister Luiz Fux, revoked the precautionary measure granted by the São Paulo Justice that allowed the opening of bars, restaurants and hotels in 19 cities of the Paraíba Valley.

The state decision kept the region under the rules of the green phase of the São Paulo Plan and was taken after the action of the Union of Hotels, Restaurants, Bars and the like in Aparecida (Sinhores). Judge Leonel Costa released the same magistrate who, on December 30, granted a precautionary measure similar to that of the municipality of São José dos Campos. The measure was also blocked by the STF, after the State Attorney General appealed.

In the new decision, Fux generalized the “suspension of each and every one of the provisional decisions that suspend, during the judicial recess, the validity of State Decree No. 65,415 / 2020, issued by the Governor of the State of São Paulo until further decision in these records. ” According to the text, any other precautionary measure granted by the State Justice would already be revoked by decision of the Supreme Court.

The decree is valid until Sunday (3/1). With it, all non-essential services are prevented from functioning. This is the case of face-to-face assistance in bars and restaurants. The goal of the São Paulo government’s decision was to avoid crowds at the end of the year festivities. However, the municipalities of São Paulo did not comply with the order, claiming that the late decision made it impossible to organize the schemes.
