STF forms the majority to maintain the mandatory use of a mask

By majority vote, the STF (Supreme Federal Court) today upheld the mandatory use of masks in areas of public and private access, a measure adopted to contain the spread of coronavirus infections. President Jair Bolsonaro’s (non-partisan) veto of excerpts from the law that orders the use of protection to combat the covid-19 pandemic had been lifted in August 2020 by the rapporteur, Minister Gilmar Mendes.

The mandatory use of a mask occurs in buses, airplanes and boats for collective use and in vehicles of individual private transport paid by passengers by application or by taxis. It should also be used in religious temples, schools, industries, and commercial establishments.

The issue was again discussed by the virtual plenary, in which the ministers cast their votes online. Those who did not attend will have their votes counted until midnight today.

The session was attended by ministers Marco Aurélio, Rosa Weber, Cármen Lúcia, Alexandre de Moraes, Dias Toffoli and Edson Fachin, the latter being the only one of the ministers who made reservations, although he also had a positive vote to maintain the mandatory use of masks .

The Senate had approved on July 4, 2020, the bill that requires the use of masks in all accessible public and private places in the country. The text had received the approval of the Chamber of Deputies, but had changes by the senators. Before mandatory national law, local governments adopted the measure to contain the new coronavirus.

Failure to comply with the law results in a fine, which is stipulated by the states. If the citizen has committed the crime for the second time, in a closed environment, the amount to be paid should be more expensive. All the money raised by the sanctions related to the absence of masks will go to the health services.

The economically vulnerable population is exempt from paying a fine for the misuse of masks; autistic; people with intellectual or sensory disabilities and children under three years of age.

The use of masks has been recommended as one of the most effective strategies to combat covid-19 by Anvisa (National Health Surveillance Agency), WHO (World Health Organization) and CDC (Center for Disease Control and Prevention ), the regulatory body of the United States Health System, as well as other municipal, state and international entities.

Combined with social detachment, the mask can prevent infected people from transmitting the virus and prevent people without infection from having mild conditions or, in most cases, not being contaminated with the new coronavirus.
