The Court of Justice of Rio Grande do Sul today received the complaint from the Public Ministry and six people were charged with the death of João Alberto Silveira Freitas, a 40-year-old black man who was beaten by security guards in Carrefour, in the north of Porto Alegre. on November 19. Adriana Alves Dutra, an inspector of the institution, was under house arrest.
According to Judge Cristiane Busatto Zardo, “there is sufficient evidence of authorship, of the six accused, in the filming and statements of the witnesses.” According to the magistrate, one of Carrefour’s employees, Adriana Alves Dutra, had “direct action in the event” and “would have supervised all the actions of the accused Magno and Giovane,” the security guards who are in prison.
Adriana had temporary detention converted into preventive detention but, due to a severe and chronic nephrological disease, confirmed by the defense, the employee will respond under house arrest.
Of the six defendants, three respond as “less important” participants. Paulo Francisco da Silva, Rafael Rezende and Kleiton Silva Santos, all employees of the establishment, will respond to the process in freedom. For the judge, the accused “meets the subjective requirements to respond to the fact in freedom.”
“They do not have a criminal record, they have a fixed job and residence. They do not represent a risk for criminal investigation and do not show a risk of evading the process, at least not until now,” the judge justified in decision.
The complaint
The six defendants were denounced for triple homicide qualified with occasional fraud, for vile motive, cruel means (which resulted in suffocation) and an appeal that made it difficult to defend the victim. The MP-RS presented the complaint yesterday at a press conference at the headquarters of the Public Ministry. According to the text, the accused “ran the risk of producing the result of the victim’s death.”
The undersecretary of Justice, Marcelo Dornelles, highlighted “the lack of preparation of the security agents, the contempt and disdain that is given to many people and the contempt for the pain of others.”
Who are the accused:
