Senate approves CNH term increase to 10 years

The project that increases the maximum period of validity of the National driver’s license (CNH) Approved by the Senate this Thursday 3. The text establishes several changes in the Brazilian Traffic Code (CTB) and as it was modified by the senators, it must be analyzed again by the Chamber of Deputies.

The government treats the project as a priority and in June of last year, President Jair Bolsonaro himself went to the Chamber to personally deliver the text. According to the project, the driver’s license expiration dates are as follows:

New terms of validity of CNH

  • 10 years – less than 50 years
  • 5 years – 50 years or more and less than 70 years
  • 3 years – 70 years or older

According to the Traffic Code, currently the driver’s license must be renewed every three years for those over 65 and every five years for most drivers.

The proposal presented by Bolsonaro initially provided for the renewal of exams every 10 years for those under 65 and for those over that age, every five years.

Drunk driver

Current law says that prison can be replaced by restrictive rights if the crime is guilty (unintentionally). Therefore, if a driver who is intoxicated or under the influence of drugs commits bodily injury or even homicide, the sentence he receives can be exchanged for an alternative sentence.

Now, the rapporteur of the project, Ciro Nogueira (PP-PI) accepted a suggestion to change the text of Senator Fabiano Contarato (Rede ES). The amendment provides that in cases of bodily injury and homicide caused by a drunk driver, even if it is unintentional, the prison sentence cannot be replaced by a more lenient one.

In addition, Ciro Nogueira added to the current text under analysis, carrying alcoholic beverages in the vehicle will be considered a serious offense, applying a fine. The type of drink can only be carried in the trunk or trunk of the car.

Senator Mara Gabrilli (PSDB-SP), who was left a quadriplegic after suffering a traffic accident, defended a better discussion on the issue and that the vote be postponed. The minority leader, Randolfe Rodrigues (Rede -AP), presented a request asking for the vote to be postponed. The proposal was rejected by 39 to 30 votes.
