The Senate approved a bill that sanctions public officials and security professionals for claims motivated by prejudice. The proposal was presented by Senator Paulo Paim (PT-RS) after the death of João Alberto Silveira Freitas, 40, who was beaten in a Carrefour supermarket in Porto Alegre on November 19.
The proposal prohibits the action of public, civil or military agents, motivated by discrimination or prejudice of any nature, in particular race, color, ethnicity, religion, nationality, gender or sexual orientation. The device ranges from actions related to public safety to inspections and surveys.
Currently, the Penal Code provides for the detention of six months to three years for a public official who practices violence in the exercise of his function, in addition to the penalty corresponding to the violence itself. The Senate bill, which will go to the House, increases the penalty by 50% if the crime is motivated by discrimination or prejudice. The proposal places the same punishment in the Racial Crimes Law and also in the Abuse of Authority Law, directed at police officers, prosecutors and other authorities.
“The vote on this bill will reduce it, it will reduce it, at least it will reduce violence against blacks and all those discriminated against,” said Paulo Paim, noting that the measure was approved by senators on International Human Rights Day. If approved in the Chamber, the proposal will still depend on the sanction of President Jair Bolsonaro.
