The Senate approved on Wednesday (9) the creation of a program of financial aid to private schools that lost income during the pandemic. The text goes on to be analyzed by the Chamber of Deputies.

The proposal is aimed at private institutions of basic education, from preschool to high school. Schools affected by social isolation measures and whose gross annual income in 2019 was equal to or less than R $ 4.8 million can be added to the benefits.

The project provides for a monthly assistance of up to R $ 10,000 to the institutions, even this year, and also the option of suspending the payment of federal taxes included in the National Simples.

The text alters the law of a program that allows the reduction of the working day and salary of workers, in addition to the temporary suspension of contracts. The project clarifies that private schools can adhere to the rules, provided they add, last year, a gross income equal to or less than R $ 4.8 million.

In this case, there is the option of reducing the working day by 25%, 50% or 70%. Employees with reduced work hours or a suspended contract will receive emergency assistance from the government, subject to the unemployment insurance limit.

The employer has the obligation to guarantee the worker’s employment for a period equal to that of the reduced working day or suspension of the contract.

According to the approved proposal, the Brazilian Micro and Small Business Support Service (Sebrae) will be able to provide free advice to school administrators.

The text was written by Senator Jorginho Mello (PL-SC) and was denounced in the Senate by Daniella Ribeiro (PP-PB).

The leader of Citizenship, Eliziane Gama (MA), asked the rapporteur to include a provision that the beneficiary schools would not be able to fire teachers, without cause, until the end of the state of public calamity.

Daniella Ribeiro explained that, after meetings with representatives of the government and the industry, there was consensus that this guarantee is already in the law that authorizes the reduction of wages and the suspension of contracts. So the suggestion was not accepted.

Installments from R $ 3,000 to R $ 10,000

The project determines that the Federal Government will make available, this year, R $ 3 billion to help private schools.

This money, according to the text, will be distributed through a monthly aid to educational institutions, whose value can vary between R $ 3,000 and R $ 10,000 depending on the number of students enrolled.

According to the proposal, the criteria for granting the benefit will be defined in a future regulation.

The text says that the condition for schools to receive aid is that they offer scholarships, in 2022, with values ​​”corresponding” to those received by the program and for at least 5% of enrollment.

The proposal postpones the payment of taxes to be paid by educational institutions. According to the text, federal taxes, collected in the form of National Simples, corresponding to the period from May to November, will be suspended until December 31.

When the school begins to pay, beginning in January of next year, interest equal to the Selic rate will be applied on the amounts owed.

Debts can also be paid in 12 installments. If the school decides to pay in installments, the first payment must be made before May 1, 2021, a grace period of four months.

According to the proposal, the benefit of the suspension of contributions will also apply to those debts that were previously paid in installments by the Federal Revenue Service and the Office of the Attorney General of the Republic of the National Treasury (PGFN).

Simples unifies the collection of a series of taxes, such as the IPI (federal tax on industrialized products); Cofins (federal, on company income), ICMS (state, on circulation of goods); ISS (municipal, on services); and another.

This regime is aimed at micro and small businesses. A single document is issued to facilitate the collection of this set of taxes.

Although Simples collects taxes at the federal, state, and municipal levels, the project deals only with the deferral of federal taxes.

Resources against coronavirus

Also on Wednesday, the senators approved two provisional measures, which provide resources to the Ministry of Health for actions to combat the new coronavirus pandemic.

One of the proposals opened a loan of R $ 10 billion. The other, R $ 5.5 billion.

As the texts were approved by the Chamber and the Senate, with the same wording sent by the Executive, the provisional measures will be promulgated by the National Congress.
