President Jair Bolsonaro signed vetoes on Tuesday (13) the law that changes the Brazilian Traffic Code and, among other things, increases the validity of the CNH (National Driver’s License).

The project was proposed by the president himself last year and underwent changes in Congress until it was approved on September 22, when World Car Free Day is commemorated, a date used to raise awareness about the negative impacts of individual motorized transport.

Changes to the Traffic Code have been criticized by road safety experts for allowing drivers to commit more infractions by increasing the point limit at the CNH, among other things.

Once promulgated, the law will take effect in six months, that is, in April 2021.

DURATION

Today, drivers up to age 65 must renew their license every five years and every three years for the elderly. In the new law, this period becomes ten years for drivers under the age of 50. Those between the ages of 50 and 70 will still need to renew their driver’s license every five years. Drivers over 70 must renew every three years.

CNH SCORE

The Traffic Code provides for a scoring system that varies according to the seriousness of the offense committed. Minor infractions, such as stopping the vehicle in a crosswalk, score 3 points. An average violation, such as parking a vehicle that blocks a garage, scores 4 points. Serious infractions, such as not wearing a seat belt, add up to 5 points. The very serious ones, such as driving with expired CNH, add 7 points.

Today, when the driver accumulates 20 points in less than a year, he has the right to drive while suspended.

The text approved by Congress and sanctioned by the president increases these limits. If the driver has not committed a serious offense in the previous 12 months, the limit will be 40 points. If you have committed a very serious infraction, it will be 30. If there are two very serious infractions in a year, the 20 point limit is maintained.

For drivers who work with vehicles, such as taxi drivers, app drivers or truckers, the limit will be 40 points in any situation, whether or not you have committed a very serious infraction. In this case, professional drivers will be able to take a refresher course every time they reach 30 points in a maximum of 12 months.

Minor and medium infractions will be punished only with a warning if the driver is not a repeat offender in the same infraction in the last 12 months.

Drivers can choose to receive tickets through an electronic system, which will also have the option to appeal. If you recognize the violation and do not present a defense or prior appeal, you will have a 40% discount on the fine.

LIGHTHOUSE

With the new rule, drivers will have to turn on their headlights during the day only on single-lane highways. New vehicles must also be built with daytime running light (DRL), a specific headlamp for use during the day.

CHAIR

Congress also included in the CTB the mandatory seat for children up to ten years old who measure less than 1.45 m.

MOTORCYCLES

The new rule increases the minimum age for riding on the back of a motorcycle from 7 to 10 years.

BENEFITS FOR GOOD DRIVERS

The law creates the National Positive Drivers Registry, which will register drivers who have not committed a traffic violation subject to scoring in the last 12 months. The federal government, states, and municipalities can grant tax or duty benefits to drivers with a positive record.

BIKES

The law includes as a serious offense parking in bike lanes or bike lanes. Not slowing down when passing cyclists is also beginning to be considered a serious offense.

AUTONOMY

The new law authorizes municipal traffic agencies, such as São Paulo’s CET (Companhia de Engenharia de Trafic), state and federal agencies, such as the Federal Highway Police, to also apply the suspension of the right to drive.

Vehicles will only be licensed if they demonstrate that they comply with manufacturers’ recall campaigns.

TOXICOLOGICAL EXAM

President Jair Bolsonaro tried to eliminate in the bill presented last year the mandatory toxicology test for professional drivers with CNH of categories C, D and E, who drive trucks and transport passengers. The demand, however, was upheld by the parliamentarians.
