The newspaper The State of S. Paulo announced this Wednesday (11/11) the full hearing of the process in which the influence Mariana Ferreira Borges, known as Mariana Ferrer, accuses businessman André Aranha of rape.
The case gained repercussion after the Interception reported on the case, noting that the judge had accepted the thesis of the “guilty violation” against André, an expression that was not used by either party.
In the sentence, the judge determined that, since it was not possible to determine the vulnerability of the victim (since the toxicological tests showed that she was not drunk or drugged), and in the absence of “guilty rape”, the principle would be valid. in doubt for the accused. In excerpts from the hearing published on the website, Aranha’s lawyer, Cláudio Gastão da Rosa Filho, presented photos produced by Mariana and posted on her Instagram profile that he described as “gynecological,” saying, among other things, that “never would have a daughter “of the” level of Mariana. He also claimed that Ferrer was putting on a “little show” and that his “earning bread was the shame of others.”
The enormous repercussion caused the OAB of Santa Catarina to inform that a letter has already been sent to the lawyer requesting preliminary information to proceed with the investigation of the case.
The National Council of Justice was also mobilized: the counselor Henrique Ávila requested an investigation into the conduct of Judge Rudson Marcos, since he did not prevent the lawyer from humiliating the influence.
The same was said of the prosecutor in the case, Thiago Carriço de Oliveira, and the National Council of the Public Ministry clarified that it had already had an investigation procedure open since October.
The Public Ministry of Santa Catarina itself, in turn, requested the disclosure of the video with the entire session to make it clear that both the prosecutor and the judge had intervened to protect Mariana.
