Insured persons of the National Institute of Social Security (INSS) may increase the benefit amount on an administrative basis. That is, without having to go to court. In some cases, you can accumulate benefits, add contributions, or request reviews to earn more.
The beneficiary can jointly receive retirement and pension or two pensions, for example. However, many are unaware of their rights or have doubts about the INSS rules. Especially after the Pension Reform went into effect on November 12.
Even the lawyer from the Institute for Social Security Studies (Ieprev) Roberto Carvalho Santos explains that after the reform, the rules on the accumulation of benefits have changed. With that, today the insured earn less. Understand!
Accumulation of benefits
In relation to two pensions or pension plus retirement, the insured now only receives the full value benefit in full. As for the second benefit, there will be a discount. The amount will be divided into portions of the minimum wage and a reducer will be applied to each portion. The total payment of the two benefits only occurs if the value of both is a minimum wage (R $ 1,045, in 2020).
In the case of the accumulation of two pensions, the value of one of the benefits will not be reduced. However, as long as it is granted under different social security systems. That is, one from the INSS and the other as a public servant. The rule is also valid for professionals, such as teachers and doctors. This group can contribute to the General Social Security Scheme (RGPS) or to the Social Security Scheme (RPPS).
Benefit Reviews and Inclusions
The insured can still request the recalculation of the benefit in some cases. The period in which the worker was on disability leave can generate a increased income. This is because the time when you received sickness benefit or disability retirement can enter the account. However, only if the insured has made a contribution to the INSS after being discharged. Anyone who has already retired and left the absence can request a review.
Another rule that benefits the taxpayer is the right to count the work done in childhood, before the age of 16, in retirement. The municipality accepts this inclusion since 2018. However, the insured must have proof of activity, such as photographs or receipts.
How to request a new calculation?
The insured who is entitled to the accumulation of benefits, inclusion of contributions or reviews can contact the INSS through the central 135. The service is open from Monday to Saturday, from 7 to 22 hours. Another option is to apply through the My INSS application or the website.
