Do TJ-SP The 4th Criminal Chamber of the Court of Justice of São Paulo sentenced two security guards from a supermarket in the south of the capital on Tuesday (24) for the crimes of torture, bodily injury, deprivation of liberty and revelation of scenes of nudes of vulnerable, committed against a teenager caught trying to steal chocolate bars. The penalties were arbitrated for ten years, three months and 18 days in prison, in a closed initial regime.

It is said in the records that, in August of last year, the defendants approached the young man and took him to a room in the establishment. The teenager was stripped, bound and gagged, and whipped with a braided electrical harness. In addition, the defendant filmed the assault and spread the images on the internet. In 1st degree, they were convicted of bodily injury and acquitted of the crime of torture.

According to the rapporteur of the appeal, Ivana David, after detaining the adolescent, it was up to the security guards to present him to the competent authorities. Instead, they subjected the victim to “intense physical and mental suffering”, intentionally committing the crime of torture.

The magistrate also pointed out that “there is no way to deny the imposition of the moral and psychological suffering derived from the dissemination of the images – only these show the immense emotional shock caused to the victim, exposed naked and gagged, spilling much of the mere punishment and humiliation already inflicted and slipping into sadism and pedophilia, indicative of contempt for the human condition ”.

The trial, voted unanimously, was attended by judges Camilo Lellis and Edison Brandão.
