The president of the Electoral Commission of the Brazilian Bar Association of Santa Catarina (OAB / SC), Paulo Fretta, affirms that, in the legislation, there is no figure of summary expulsion within the parties. According to the specialist lawyer in the area, before the candidate is removed from office, there is an internal process carried out by each party that must grant the right to a broad defense. The deadlines are not fixed.
“The party has autonomy to carry out the process and it may even accelerate a bit during this period. But if the party expels, the party itself can request the cancellation of the registration of the candidacy in the Electoral Court, ”said Fretta.
If the candidacy is canceled before the elections, Pugliesi will not be able to stand for election. According to the Electoral Law, membership is one of the eligibility conditions.
