Robinho’s defense came out on Thursday afternoon on the second instance sentence of nine years in prison for sexual violence against an Albanian woman in 2013 in Italy.

In a note delivered to the press, the player’s lawyers assure that they will present a new appeal, now in the Court of Cassation, a court of the country’s judicial system equivalent to the Federal Supreme Court of Brazil.

Although the nine-year sentence was confirmed in Thursday’s trial at the Milan Court of Appeal, the defense reinforces that the player is innocent.

Robinho and Ricardo Falco were sentenced for the first time to nine years in prison for group sexual violence in November 2017 against an Albanian woman. The case happened in a Milan nightclub called Sio Café, in the early morning of January 22, 2013, when the player was defending Milan, from Italy.

Four other Brazilians reportedly participated in the event. Leaving Italy in the course of investigations, they are being sued in a separate proceeding, currently under arrest.

Robinho and Falco were convicted on the basis of article “609 bis” of the Italian penal code, which speaks of the participation of two or more people gathered for an act of sexual violence – forcing someone to have sexual relations because of their “physical inferiority or psychological “. .

When questioned in April 2014, Robinho denied the charges. He admitted that he had sex with the victim, but said it was a consensual oral sex relationship with no other people involved. In the reconstitution carried out by the Justice, the victim of Albanian origin said that he went to the Sio Café on January 21, 2013 to celebrate his 23rd birthday with two friends. That day, the club’s programming was dedicated to Brazilian music.

Still according to the testimony, on the night of the episode, the victim said that he went to the place invited by one of Robinho’s friends, but that, by SMS, he informed him that he should only approach the table after his wife left. of the player. .

As soon as this happened, she and two friends joined the group of Brazilians, which later was also attended by Ricardo Falco. According to the victim, the Brazilians offered her various alcoholic beverages, but only she drank, since one of her friends was pregnant and the other was driving.

Around 1:30 am, the two friends left and one of them promised to come back to pick her up. After dancing with the Brazilians, out of breath and dizzy, she said she headed to an area outside the nightclub, when one of the player’s friends (one of the defendants in the lawsuit standing aside) tried to kiss her . Shortly after, the two headed to the dressing room, where the same friend kept trying to kiss her.

The victim admitted to having only “a few flashes that night”, adding that she was unable to “speak” or “stand up”. According to her recollections, she stayed alone for a few minutes and “realized” that the same friend and Robinho were “taking advantage” of her.

In the sentence, several recordings of telephone calls between the accused were transcribed, made with the authorization of the courts. One of the most decisive for the conviction in the first instance was a conversation between Ricardo Falco and Robinho that indicated to the court that those involved knew the victim’s condition.

The only one present at the Milan nightclub who began to serve the sentence imposed by the Justice is the Brazilian musician Jairo Chagas, who has lived in Italy for years and who was playing that night at Sio Café. The crime would have occurred in his dressing room, like the reconstruction carried out by the Prosecutor’s Office.

He was convicted of false testimony before the Italian justice. In one of the intercepted recordings, Jairo tells Robinho by phone that he saw the player “put his penis in his mouth.” In testimony, however, the musician said he did not see sex scenes that night.
