In August, by six votes to one, the Superior Electoral Court (TSE) approved the proportional division of campaign funds and advertising on radio and television, but defined that the rules could only be applied from 2022.

The decision took into account the principle of prior notice, which prevents the application of changes in the electoral process less than a year after the vote itself. The proportional division of resources was defined after consulting with the deputy Benedita da Silva (PT-RJ) and entities of the black movement.

Lewandowski’s decision responds to a request from PSOL, which called the Supreme Court asking for the immediate application of the new rule.

The minister also pointed out that the proportional division of resources and advertising time cannot be considered a change in the electoral process. Therefore, there is no reason to impose the prohibition provided in the Constitution.

“The record shows that the TSE did not promote any innovation in the rules related to the electoral process, conceived in its strictest sense, since it did not modify the discipline of party conventions, nor the electoral coefficients or the extent of the vote. universal ”, says the minister.
