As of this Tuesday (1), the resolution of Contran (National Transit Council) that restores deadlines for CNH regularization (national driver’s licenses) expired.

Under the new resolution, the qualification documents that were to be submitted in 2020 gained another year of validity. As a result, the renewal of the CNH expiring in 2020 will take place gradually, according to a schedule established in the document.

The measure also includes ACC (Authorization to Drive Mopeds) and PPD (Permit to Drive), a provisional document used in the first year of the driver’s license. According to the text, the renewal will occur depending on the month in which the document expires.

Also according to the resolution, for inspection purposes, any qualification document expiring in 2020 must be accepted until the last day of the corresponding month in 2021.

The measure, published on the 24th, repealed an ordinance published in March by the agency, which suspended the deadlines to renew the CNH, impose fines, transfer vehicles, register and license new vehicles, among others, due to the pandemic. of the new coronavirus.

Vehicle transfers

The resolution also determines that, as of December 1, 2020, the terms for services such as vehicle transfer, commercial communication, change of address, are resumed, as provided in the CTB (Brazilian Traffic Code).

Regarding the transfer of vehicles purchased from February 19, 2020 to November 30, 2020, Contran says that the state departments of Traffic (Detrans) of the states and the Federal District may establish a specific schedule for the effective transfer ownership and that must be reported to Contran before December 31, 2020.

If the Detrans do not establish a specific schedule, the transfer of ownership of the vehicle acquired in the indicated period must be effective until December 31, 2020.

For new vehicles, purchased from February 19, 2020 to November 30, 2020, the date January 31, 2021 will also be valid for registration and effective licensing.

Offenses

The resolution also retakes, as of today, the terms established for the offenses committed, such as the terms for the defense of the lien and fines; procedural defense and suspension of the right to drive and confiscation of the driver’s license, as well as identification of the offending driver and issuance of notifications of warnings.

In the case of notifications already sent, the resolution postpones until January 31, 2021 the deadlines for the presentation of prior defense and indication of the driver, after March 20, 2020. The same period applies to notifications of sanctions.

Regarding the sending of notifications registered from February 26 to November 30, a 10-month schedule will be observed. This period will be counted from the date of the offense. Thus, for example, drivers who committed violations in February and March 2020 should receive notifications of evaluations sent in January 2021.

“The transit authority should provide, whenever possible, a different design for the shipment of NA [notificações de autuação] derived from an infraction committed from February 26, 2020 to November 30, 2020, clearly highlighting that these notifications have different deadlines ”, says the resolution.

The terms of the licenses to operate as an authorized technical institution (ITL), expiring from March 20, 2020 to November 30, 2020, extend until January 31, 2021.
