The Civil Police of Rio Grande do Sul charged this Friday (6) six people for triple qualified homicide: for unpleasant reasons, suffocation and a resource that made defense impossible of the victim – in the case of João Alberto Silveira Freitas, a black citizen murdered after being beaten by two white security guards on November 19 in a Porto Alegre supermarket. Despite this, the accused will not be responsible for the crime of racial damage, after racism has been identified as the cause of the crime by the family of João Alberto.
“We made a conjunctural analysis of all the evidentiary and doctrinal aspects and concluded, therefore, that the structural racism that are those concepts rooted in society were, indeed, fundamental to determine the conduct of these people in that case. , since among the six there were also black people, and therefore, they also had the same way of behavior. That is to say, ingrained in them, old conceptions of discrimination for not only skin color, the skin color of the victim, in this case. But also because of its socioeconomic condition. We understand that another person, at that time, in that place, could be treated differently, ”said Chief Roberta Bertoldo.
According to the investigation, the testimonies evidenced the indifference of the employees linked to Carrefour and the security company Vector with respect to the actions they committed against the victim. The situation was described as “degrading” and “inhumane”.
For the police, in addition to the attacking security guards, the other four defendants contributed to the death by keeping the victim and the victim’s wife at a distance, making any assistance to the victim unfeasible.

Security guards Giovane Gaspar da Silva, 24, and Magno Borges Braz, 30, have been arrested since the day of the crime. In addition to them, the market surveillance agent, Adriana Alves Dutra, 51, who was following the actions of the security guards, was also arrested.
The investigation also leads to the conclusion of the cause of death of João Alberto. According to an autopsy performed by forensic doctors from the Legal Medical Department, the victim was killed by suffocation.

The police requested the preventive detention of Adriana Alves Dutra, Paulo Francisco da Silva, Rafael Rezende and Kleiton Silva Santos. He also represented the Justice for the maintenance of the preventive prison of Giovane Gaspar da Silva and Magno Braz.

He added that the situation did not involve theft of merchandise from the store, which does not require immediate activation of security. According to him, after a few minutes, the store supervisor, Adriana Alves Dutra, shouted over the radio that it was for the security center to activate the Military Brigade.
The reason reported by the employee for the request for support was that she considered that the gaze of João Alberto, who said he was looking at her, was “aggressive.” She also claimed that the victim had said something that she did not understand. she left and João Alberto approached her again, gesturing, she could not explain what those gestures were and said she was tense with the situation, this employee is not among the accused.
In testimony to the police, Paulo Francisco da Silva, an employee of Vector, another person responsible for the crime, narrated that, on the day of the crime, he was on the second floor of the supermarket when, around 8:30 p.m., he was informed that a man was causing disorder in the establishment. .
Upon arriving at the scene, he found the victim lying on the ground with weak vital signs but still alive.
He mentioned that, that same week, João Alberto had entered the supermarket with signs of intoxication and / or drug addiction and that some customers informed the market officials that he had been harassed.
The police showed Paulo the video in which he appears saying: “There is no scene, (…) we will notify you of another moment” to João Alberto. He explained that, a few days before, the victim had been quite upset in the supermarket and that he was even walking barefoot inside the store. In addition, he made gestures with his hands, as if to denote that he had a firearm, and he also approached people, forcing a hug.
“Two days before the event, João Alberto went to the supermarket and there are indications of harassment of other customers. The security guards approached him, he deterred the behavior and left the supermarket. But they were other employees and this event did not imply this outcome then”. the delegate concluded.
So far, Carrefour reports that it has not had access to the conclusion of the Civil Police investigation into the case that occurred on the night of November 19 in Porto Alegre.
