The Military Police investigation into the death of 13-year-old Mizael Fernandes da Silva, on July 1, concluded that the two policemen involved in the murder fired at the teenager in “self-defense and that of others.” The investigation concluded on August 24 of this year, but was secret until September 29.
The PM’s conclusion, however, contradicts the Comptroller General for Discipline of the Public Security Corps and the Penitentiary System (CGD), which in a parallel investigation convicted a policeman of homicide on September 25 of this year.

Mizael died inside his own home in Chorozinho, in the Fortaleza Metropolitan Region (RMF), when he was shot with a firearm during a police intervention. According to the family’s report, the PMs entered the residence and ordered everyone to leave the place. The teenager, who was apparently sleeping in the bedroom, was later killed.
The Military Police concluded that Mizael was armed and refused to drop the revolver, prompting the police to fire.

For Lieutenant Colonel Paulo André Pinho Saraiva, in charge of the IPM, the behavior of PM Enemias Barros da Silva, sergeant and soldier Luiz Antônio de Oliveira Jucá, is based on the “exclusion of illegality provided for in article 42, II, of the CPM – legitimate defense and that of third parties ”, he justifies.
The CGD Department of Internal Affairs (DAI) has prosecuted Enemias Barros da Silva for murder and procedural fraud. In addition to him, other soldiers who did not reveal their names were also charged with helping the sergeant manipulate the crime scene.
The Public Ministry of Ceará (MPCE) stated in a note that it is “analyzing the case and it will be announced soon.” The Military Police did not send a response until the publication of this article.
