The couple filed a lawsuit against the dog’s owner, seeking redress for the inconvenience caused. The decision of the 2nd District Court of Lagoa Santa ordered him to pay R $ 1 thousand corresponding to the amount of the announced reward and compensate them in R $ 10 thousand, for moral damage.

The pet owner appealed the decision. He says in the process that none of the comments on social media were enough to damage the personality of the couple who found the dog. He also said they knew about the search for the animal, but it took days to return it.

Judge Valdez Leite Machado, rapporteur of the process, reiterated that it was indisputable that the content of the messages was offensive and was directed at the couple who rescued their dog. He also said that it cannot be denied that the situation has caused embarrassment, especially since it is a small city.

“In this context, I understand that the illegal act of the ru is undeniable, which extrapolated the constitutionally guaranteed right to freedom of expression, to the extent that it offended the honor and image of the authors,” the magistrate analyzed.

In view of this, he fully complied with the sentence that ordered him to pay the reward and compensation of R $ 10,000 for the insults committed.

According to the rapporteur, judges Evangelina Castilho Duarte and Cludia Maia voted. the decision is still subject to appeal.
