The Public Defender’s Office of Rio Grande do Sul today filed a collective public civil action against Carrefour and the security company Vector for the death of João Alberto Silveira Freitas, 40, beaten by two security guards in the unit in the north of Porto Alegre, last Thursday (19).
The lawsuit seeks compensation of R $ 200 million for the Carrefour and Vector chain for collective and social moral damage. According to the Ombudsman’s Office, the amount should be allocated to funds to combat discrimination and consumer protection, among others.
Public defender Rafael Pedro Magagnin, from the Consumer Protection and Collective Protection group, observes that, for the definition of value, two aspects were considered: the pedagogical nature and the dimension of the damage. The first seeks to avoid future actions as happened with João Alberto. The other is due to the proportion of deaths. “The scope of the social damage is immense. Not only in the state, but in the country and in the world.”
At the press conference, public defender Andrey Régis de Melo, from the criminal defense nucleus, referred to the racial context in the death of João Alfredo.

Defender calls for unit interdiction
The Ombudsman’s Office requested that the Carrefour unit be banned for five days in order to “reduce the risks of possible hostile acts that could occur as a result of the demonstrations,” according to a statement released at a press conference.
The agency asks the supermarket chain to create a plan in 10 days to combat racism and discriminatory treatment directed at employees. It also requests the adoption of awareness campaigns on social networks and determines the placement of at least ten posters in each unit of the network in Brazil, highlighting that discrimination is a crime.
The institution also charges for the equipment of the new police station to combat intolerance, recently announced by Governor Eduardo Leite (PSDB-RS). And even if expenses are paid for the use of the Military Brigade in death demonstrations.
The agency establishes a daily fine of R $ 100,000 in case of non-compliance with the established measures.
So far, three people have been arrested: surveillance agent Adriana Alves Dutra, 51, and security guards Magno. Braz Borges, 30, e Young Gaspar da Silva, 24, who is a temporary military policeman.

Beto’s wife, Milena Borges Alves, 43, and his father, João Batista Rodrigues Freitas, 65, followed the interview.
Beto’s father said that the action of the Ombudsman is valid so that death serves as an example so that it does not happen again.
“Not only for the amount of compensation, but we must bear in mind that these cases can no longer happen in society. As it happened to my family, we must use it well (the money) so that other families do not suffer the same pain that I am suffering, ”he said.
The father said that Carrefour had already contacted the family, one of them was the president himself, and the call had a translator. Another person, who identified himself as an employee of the market network, contacted her on the day of her death offering her baskets of basic food. You suspect that the person is not from Carrefour.
“It could have been a third party. I don’t think a person from Carrefour is presenting a proposal of this carat. But I think this is the wrong way to present in such a case,” he said. “There are many speculators. (The call took place) at the time when he was waiting for his body to be released.”

In a note, Carrefour reported that it has not yet taken a formal note of the lawsuit filed by the Public Defender’s Office. The supermarket chain stressed that “it is at the disposal of the agencies to provide all the necessary information.”
