New rules are in force for retirement by age

A Social security reform, which has been in effect since November 2019, changed the rules for various types of retirement, including the retirement age, one of the most common in Brazil.

Thus, to ensure a peaceful future, it is necessary to know the new rules and conditions to request the benefit and ensure that it is approved by the National Institute of Social Security (INSS), as well as a reasonable value that meets the needs of the insured.

Next, check what has changed in retirement by age, according to the new legislation:

Retirement by age

Retirement by age is a social security benefit that aims to guarantee the protection of INSS insured persons during old age. In this case, retirement is granted when the worker reaches the age established by law.

Before the Reform, the minimum retirement age in this modality was 65 years for men and 60 years for women, and both sexes had to have at least 15 years of contributions to the INSS, which corresponds to 180 months.

With the new rules defined in the Pension Reform, the minimum age is still 65 for men, but now it has been 62 for women.

It is worth mentioning that those who met the age requirements before the Reform came into force, may retire in accordance with the above criteria. On the other hand, those who were already working before the new legislation, but had not yet met the requirements, will retire according to the transition rules. Workers who entered the market after the Reform will have to follow the new rules.

Requirements

INSS urban policyholders must meet the age and grace period or contribution time requirements. Review the transition rules for retirement by age:

  • For men: Minimum age of 65 years + 15 years of contribution, starting in 2020, another six months per year will be added, until reaching 20 years of contribution;
  • For women: Minimum age of 60 years, starting in 2020, six months a year will be added, until reaching 62 years, in 2023 + 15 years of contribution.

For those who started working after the Pension Reform was already in effect, the requirements for retirement by age are:

  • For men: Minimum age of 65 years + 20 years of contribution;
  • For women: Minimum age 62 years + 15 years of contribution.

Exceptions

Some specific categories are also entitled to retirement due to age, such as rural workers, artisanal fishermen and extractivists (rubber tappers), in addition to indigenous people.

According to the General Social Security Scheme (RGPS), insured workers can be classified in each category as follows:

  • Insured Employee: Provides services in urban or rural areas, continuously and subordinate to an employer;
  • Insured taxpayer: You do not have an employment relationship, eventually, for two or more employers;
  • Insured worker: Provides services in urban or rural areas, without employment, for various companies;
  • Special insured: Worker who lives in a rural property or agglomerate in the vicinity of rural areas, and works individually or in a family economy regime, such as rubber extractors, artisans and fishermen, for example.

Therefore, rural workers in any of the aforementioned categories and special insured persons are exceptions to the rule, and there is a reduction in the minimum retirement age. In this case, the requirement for the sport is 60 years for men and 55 years for women.
