President Jair Bolsonaro sanctioned this Thursday (1/4) the new Law on Bids and Administrative Contracts (Law 14.133 / 21) that establishes the general rules for bidding and contracting of the direct, autonomous and foundational Public Administrations of the Union, the states, the Federal District and the municipalities.
The new law replaces the previous one (Law 8,666 / 1993), the Law of Auctions (Law 10,520 / 2002) and the Differentiated Contracting Regime (RDC – Law 12,462 / 11). One of the novelties is that the regulation inserts provisions in the Penal Code to classify crimes in public tenders, in addition to requiring a guarantee insurance for major works.
Bolsonaro vetoed 26 provisions by sanctioning the new regulation. In the opinion of Jonas Lima, a lawyer specialized in bids and administrative contracts, the new regulation represents an important advance. “A law that changes paradigms, being the National Public Procurement Portal a showcase of transparency, the competitive dialogue tender modality to overcome management challenges in objects without ready solutions, BIM (Building information modeling) to streamline and reduce costs of public works, better regulation of international tenders, arbitration for conflict resolution, changes in tendering offenses and created a hypothesis of priority in the CPC for public procurement processes, in addition to other innovations “, he exalts.
