The defense of former minister Sergio Moro defended, in the Federal Supreme Court (STF), that President Jair Bolsonaro must testify in person in the investigation that investigates alleged interference in the Federal Police (STF). In the demonstration, the lawyers ask the plenary to confirm the decision of Minister Celso de Mello, rapporteur of the investigation.

The case is likely to be discussed by the STF plenary this week, the dean’s last in court: it is dropped on October 13. Celso de Mello made the process known to the agenda this Monday.

The question to be discussed is whether Bolsonaro can testify in writing. The request was made by the Attorney General’s Office (AGU) and has a history, since Michel Temer gave written testimony when he was president in 2017.

In the work, the defense of the former Lava-Jato judge maintains that, as Celso de Mello pointed out in his decision, Bolsonaro is investigated in the process, does not testify, and therefore the prerogatives provided in article 221 of the Criminal Procedure Code. which provided for the testimony of the authorities in writing, did not cover the situation of the president.

It also states that, “out of fairness,” as Moro personally testified, Bolsonaro should do the same. “The understanding of the Dean of this Supreme Federal Court highlights the equity of positions among those who hold the status of defendants in an investigation process, since the petitioner Sergio Moro was personally heard before the authorities of the criminal prosecution, in a long hearing on May 2, 2020 ”, says the text.
