The text sent by the government only modifies the rules for future servants, those who enter the career after the enactment of the constitutional reform, and does not affect the so-called members of the Powers (magistrates in the Judiciary, deputies and senators in the Legislative, for example).

For these cases, if they want to change the rules, the Judiciary and the Legislature must prepare their own texts, or change the Executive’s proposal sent to Congress.

Proposals that change the Constitution have a longer rite within Congress compared to bills.

According to the rules of procedure:

  • the text first passes through the Chamber’s Constitution and Justice Commission (CCJ), which analyzes whether the proposal violates any constitutional principle. At this stage, the merit (content) is not analyzed;
  • If the CCJ approves the constitutionality of the text, a special commission made up of deputies will be created to discuss the merits of the proposal;
  • If approved by the commission, the PEC goes on to vote in the plenary session of the Chamber, where it will need the support of at least 308 of the 513 votes, in two rounds of roll call.
