By voting against the request, Kassio accepted the contrary opinion of the Federal Public Ministry, which considered “reasonable” the refusal of possession of the producer. She affirmed, in the vote, that “there is no net and secure right to grant the request for authorization to acquire a firearm”, even when the requirements required by law are met.
He even cited the decisions of a colleague of the court, the judge also Souza Prudente, who denied possession to a military policeman, because he would not have proven his suitability.
Kassio convinced the other judges of the Sixth Class, Jirair Meguerian and Daniel Paes Ribeiro, who joined him unanimously.
