The Electoral Court accepted the appeal of the candidate for mayor of Porto Alegre Gustavo Paim (PP) and determined, on Saturday, the suspension of the publicity of the Caetano Veloso show in support of the Manuela D’Ávila (PCdoB) campaign . The judge of the 161 Electoral Zone, Leandro Figueira Martins, determined that Facebook and Instagram promote the removal of the links they called for the event, which, according to him, does not seem appropriate to the electoral legislation.
According to the author of the appeal, the law prohibits, in any case, the presentation of artists, paid or not, in order to animate electoral events. “Regardless of the dispute, there is a clear violation of the electoral legislation, because this program violates the isonomy between the candidates,” Paim said after the decision.
The coordination of Manuela’s campaign will be of interest. “We will enter with a request for reconsideration to the judge who issued the decision, considering that he analyzed the case only based on the arguments of the opponent. We are sure that the proposed collection action is fully within legal standards, since it is a closed event, with admission rights, ”he reported.
According to an announcement published on social networks, the Caetano Veloso show is scheduled for November 7 and seeks to allocate resources from online ticket sales to the campaigns of Manuela and Guilherme Boulos (PSOL), in São Paulo. The event was scheduled to take place on the live platform showIn.tv only for those who own the tickets.
The person in charge of the program, Uns Produções, who manages Caetano Veloso’s career, assures that the event is legal and had already communicated to the Electoral Justice about his performance. “The presentation will be held in a closed environment, only for ticket holders, marketed by the campaigns. The position is what differentiates the event from a show, since the law does not allow free presentations, ”he reports. “The program is super legal. Caetano would never do anything illegal, ”said producer and businesswoman Paula Lavigne.
‘Livemício’
In August, the Superior Electoral Court (TSE) unanimously banned “livemício” in the 2020 elections. The judgment was based on a consultation carried out by the PSOL to determine whether or not electoral legislation would allow the transmission of live shows although not paid – on digital platforms with the presence of candidates. Minister Luís Felipe Salomão, rapporteur of the process, argued against the possibility because he understood that “livemício” is similar to “showmício”, a practice that has been prohibited in Brazil since 2006.
